Measures for the Implementation of the Regulations on Openness of Government Affairs in Hunan Province

Chapter I General Principles

Article 1 [Legislative Purpose] These Measures are formulated in accordance with the Regulations on Openness of Government Affairs and relevant laws and regulations, combined with the actual situation of this province.

Article 2 [Scope of Application] These Measures shall apply to the administrative activities of the people's government of this province and its departments.

Article 3 [System and Mechanism] The people's governments at or above the county level shall promote the unified management of government affairs at the corresponding level, clarify the administrative departments at the corresponding level, establish and improve the administrative systems and norms, and make overall arrangements for resources.

Government departments should define an internal organization to centrally manage the affairs of their own units, implement the management system and standards of agency affairs, and accept the guidance of the competent department of agency affairs of the people's government at the same level.

Article 4 The competent department of the provincial people's government is responsible for formulating, organizing and implementing the management system of the province's organs, guiding the work of the province's organs and being in charge of the work of the organs at the same level.

The competent authorities of the people's governments of cities, counties, cities and districts are in charge of the affairs of the organs at the corresponding levels and guide the affairs of the organs at lower levels.

Where centralized office is implemented, the administrative department of the people's government at the same level shall be responsible for the administrative management of the office area.

Article 5 The people's governments at or above the county level shall adhere to the direction of socialized reform of government logistics services, establish a mechanism for the government to purchase services from social forces, and promote socialized reform of official vehicles, property management services and official reception services.

Chapter II Fund Management

Sixth people's governments at all levels and their departments should strengthen the budget management of government funds, and shall not exceed the budget or arrange expenditures without budget.

Article 7 [Quotas and Standards] The administrative department of the people's government at or above the county level shall, according to the needs of ensuring the operation of the organs, formulate the quantity, quality and technical standards for office buildings, official vehicles, office equipment, office supplies and other physical objects, as well as the service contents and grade standards for property services, travel, meetings and living security.

The financial department of the people's government at or above the county level shall organize the formulation of the quota standards and physical standards for the budget expenditure of the organs, and refer to the market prices of related goods and services according to the physical quota and service standards.

Article 8 Where the administrative department of the people's government at or above the county level uniformly organizes and implements the administrative work such as the construction and maintenance of office buildings, the renewal of official vehicles, the energy conservation of public institutions, and logistics services, the fund management shall be implemented in accordance with the relevant laws and regulations on budget management and the provisions of the provincial people's government.

Article 9 People's governments at all levels shall strictly control the scale and proportion of official reception fees, official vehicle purchase and operation fees, and funds for going abroad on business in the total government operating budget.

Government departments should strengthen the management of official reception, the purchase and operation of official vehicles, and the expenditure of going abroad on business, and further refine the public contents of the budget and final accounts.

Article 10 [Government Procurement] People's governments at all levels and departments of people's governments at or above the county level shall strictly implement the laws and regulations on government procurement, and projects belonging to the centralized procurement catalogue shall not be decentralized by themselves.

Government centralized procurement institutions should improve procurement efficiency, reduce procurement costs and ensure procurement quality.

Article 11 [Assessment System] The people's governments at or above the county level shall establish and improve the statistical report and performance assessment system for the operating expenses of organs, and organize departments such as finance and organ affairs to carry out statistics, analysis and assessment of the operating expenses of organs.

Chapter III Asset Management

Article 12 The administrative department of the people's government at or above the county level shall, according to the form, nature and division of responsibilities of assets, study, formulate and organize the implementation of the specific system of government asset management with the goal of asset allocation, use, disposal and statistical evaluation, and accept the guidance and supervision of the relevant departments of finance, development and reform, land and resources at the same level.

Article 13 [Asset Allocation Management] The administrative departments of the people's governments at or above the county level shall, according to the provisions on asset management, the level of economic and social development, the requirements for energy conservation and environmental protection, and in combination with post responsibilities, working conditions and the number of institutions, classify and formulate asset allocation standards for public institutions, and report them to the people's government at the same level for approval before implementation.

Government departments shall, according to the asset allocation standards and asset stock status, prepare their own annual asset allocation plans, which shall be used as the basis for the financial department to approve the departmental budget after being audited by the competent department.

Article 14 [Daily Management of Assets] Government departments shall strictly implement the asset management system and strengthen the daily management of their own assets, and shall not use their own assets for guarantee, mortgage, foreign investment or establishment of economic entities, and shall not rent or lend their own assets without authorization.

Article 15 The administrative department of the people's government at or above the county level shall, in accordance with the provisions of the people's government at the corresponding level, uniformly transfer and use the idle or inefficient assets of various departments. If it cannot be adjusted or used any longer, it shall be disposed of by auction, and the proceeds from the disposal shall be turned over to the state treasury in full.

When adjusting the use or disposal of agency assets, the asset accounts of relevant agencies shall be adjusted in time.

Sixteenth people's governments at or above the county level shall, in the preparation or revision of the overall urban planning and detailed planning, make overall consideration of the arrangement of land used by government agencies according to the requirements of functional zoning and intensive land use. Encourage government agencies to implement centralized office.

The real estate administrative departments of the people's governments at or above the county level shall implement unified real estate management for the land used by the organs at the same level and apply for ownership registration in a unified way.

Seventeenth people's governments at or above the county level shall strictly implement the management system of office building construction. Conditional, can be unified by the people's government at the same level to organize the construction of office space.

Government departments shall, in accordance with the relevant provisions of the people's government at the corresponding level, strengthen the unified management of the construction of office buildings of various government departments at the corresponding level.

Article 18 The administrative departments of the people's governments at the same level shall uniformly apply for ownership registration and allocate office buildings for use.

Article 19 The administrative departments of the people's governments at or above the county level shall strengthen the maintenance and management of office buildings of government organs at the same level and formulate measures for the maintenance and management of office buildings. Conditional, can be unified by the competent authorities to organize the implementation of large and medium-sized maintenance and transformation of government agencies at the same level. The daily maintenance of the office building is the responsibility of the user.

Article 20 The administrative department of official vehicles of the provincial people's government shall, jointly with relevant departments, formulate measures for the administration of the use of official vehicles in the province, which shall be implemented after the approval of the provincial people's government. The specific provisions on the management of law enforcement vehicles shall be formulated by the financial department of the provincial people's government in conjunction with relevant departments.

The competent department of official vehicles of the people's governments at or above the county level shall be responsible for the preparation and approval of official vehicles of the organs at the same level, and report to the competent department of official vehicles at the next higher level for examination and filing.

Article 21 [Daily Management of Official Vehicles] All government departments shall strictly implement the management system for the allocation and use of official vehicles and strengthen the daily management of official vehicles. It is not allowed to exceed the standard, exceed the establishment and update official vehicles.

Chapter IV Service Management

Article 22 The administrative departments of the people's governments at or above the county level shall, jointly with the departments of development, reform and finance, formulate specific systems for the management of logistics services at the corresponding level, determine the items and standards of logistics services at the corresponding level, strengthen the guidance and supervision of logistics services at the corresponding level, and rationally allocate and economize the use of logistics service resources.

Government departments should establish and improve their own logistics service management system, strengthen and standardize logistics services, and shall not provide logistics services beyond the prescribed items and standards.

Twenty-third people's governments at or above the county level shall establish and improve the energy-saving management system of public institutions and promote the energy-saving work of public institutions. The departments of the people's governments at or above the county level in charge of energy conservation in public institutions shall be responsible for the supervision and management of energy conservation in public institutions at the same level under the guidance of the departments in charge of energy conservation at the same level, and guide and supervise the energy conservation in public institutions at lower levels.

Article 24 The administrative department of energy conservation of the people's government at or above the county level shall, jointly with the competent department of energy conservation and other relevant departments, formulate energy conservation plans and energy resource consumption quotas for public institutions at the corresponding level, and formulate and organize the implementation of energy conservation plans and target assessment methods for public institutions at the corresponding level. Government departments should strengthen energy-saving management and energy-saving publicity and education, promote the application of new energy-saving products and technologies, eliminate high-energy-consuming facilities and equipment, and improve the efficiency of energy resources utilization.

Article 25 People's governments at all levels shall establish and improve the management system of official reception, and manage and standardize official reception according to the principles of being pragmatic, frugal and simplifying etiquette.

The administrative department of official reception of the people's government at or above the county level shall, in combination with local conditions, formulate the scope and standards of official reception of the organs at the same level in conjunction with the departments of finance, auditing and supervision, and report them to the people's government at the same level for approval before implementation.

Twenty-sixth government departments should strengthen the management of meetings, strictly control the number, duration and scale of meetings, and strictly implement the scope and standards of meeting expenses. It is necessary to make full use of internal organs, television and telephone, network video and other means to hold meetings and save meeting expenses.

Government departments should strictly implement domestic travel management regulations, strictly control the number and days of domestic travel, and must not engage in travel activities with no clear official purpose, travel in disguise in the name of official travel, or conduct study, exchange and inspection without substantive content.

Government departments should strictly implement the regulations on going abroad (abroad) on business, strictly control the number of delegations and personnel going abroad (abroad) and the stay time outside the country (abroad), and may not arrange inspection and training unrelated to the business work of their own units.

Article 27 The administrative department of the people's government at or above the county level is responsible for studying and formulating the specific system of property service management of the organs at the corresponding level and organizing its implementation, and guiding and supervising the property service management of the organs at the corresponding level. Government departments should strictly implement the property service management system of the organs at the same level.

Chapter V Supervision, Inspection and Legal Responsibility

Article 28 The people's governments at or above the county level shall establish a joint meeting system of government supervision and inspection, strengthen overall coordination and information communication, regularly organize government affairs, development and reform, finance, land, housing and urban and rural construction, auditing and supervision departments to conduct government affairs inspection, and incorporate the construction of conservation-oriented organs into performance appraisal.

Twenty-ninth [report and complaint handling] administrative departments of the people's governments at or above the county level shall establish a system for reporting and accepting complaints on government affairs, and handle reports and complaints in a timely manner.

Thirtieth [legal liability] in violation of the provisions of these measures, shall be punished according to laws and regulations; In any of the following circumstances, the higher authorities shall order it to make corrections, and the appointment and removal organ or the supervisory organ shall give a warning to the responsible person; If the circumstances are serious, demerit or gross demerit shall be given; If the circumstances are serious, demotion or dismissal shall be given:

(a) the illegal construction of office space or the use of office space and official vehicles in accordance with the provisions;

(2) Failing to use special funds for the construction and maintenance of office buildings, the equipping and updating of official vehicles, official reception, expenses for going abroad on business, energy conservation of public institutions, etc.;

(3) Disposing of agency assets without authorization according to the prescribed procedures;

(4) Organizing inspection activities unrelated to the meeting;

(six) other violations of government regulations.

Chapter VI Supplementary Provisions

Article 31 The administrative activities of other state organs and relevant people's organizations shall be implemented with reference to these Measures.

Article 32 These Measures shall come into force as of the date of promulgation.
