In order to further improve the use function of existing houses in our city, improve the livability level and improve the living conditions, according to the Property Law of People's Republic of China (PRC), Guiding Opinions on Installing Elevators in Existing Houses (No.28 [2020] of Jin Zi), Measures for the Safety Management of Elevators in Taiyuan City, etc., combined with the actual situation in our city, we now put forward the following implementation opinions on installing elevators in existing houses in our city.
I. Basic principles
The work of installing elevators in existing houses follows the principle of "voluntary owners, government guidance, standardized implementation and safety guarantee". Give full play to the main role of residential owners and ensure that elevator installation is scientific, reasonable and feasible through democratic consultation according to law. Give full play to the coordination and service functions of the government, standardize guidance and optimize examination and approval, and ensure that the people really get benefits.
Second, the installation conditions
(a) to apply for the installation of elevators in existing houses, it shall have the legal ownership certificate, which is not included in the demolition and reconstruction plan of shanty towns (dilapidated houses) and urban villages, and meets the requirements of building structural safety, fire safety and safe evacuation.
(2) Where an application for installing an elevator in an existing residence is made by a unit, a whole building or a residential area, all the owners of the unit, the whole building or the residential area shall fully negotiate in accordance with the Property Law and other laws and regulations, reach an agreement according to law, and properly handle the adjacent relationship.
Third, the main body of implementation
The relevant owners of this unit, this building or this residential area are the main implementers of installing elevators in existing houses, and are responsible for unified opinions, project declaration, equipment procurement, project implementation, maintenance management and other related work.
The implementer may entrust the owners' representatives, community neighborhood committees, property service enterprises, units with design and construction qualifications, elevator installation and maintenance enterprises, original construction units and property rights units as agents to be specifically responsible for the above work. The trustee shall sign an entrustment agreement with the principal to clarify the rights and obligations of both parties.
Encourage government agencies, enterprises and institutions to organize the implementation of self-management employee housing elevator installation.
The person who installs the elevator shall bear the responsibilities and obligations of the construction unit.
Fourth, raise funds.
The construction funds, operation, maintenance and management funds required for installing elevators in existing houses are mainly borne by the owners, and the specific costs are shared in proportion according to the floor of the owners and other factors. Construction costs can be used for housing owners and their spouses to apply for housing provident fund.
For the installation of elevators in existing residential buildings with four floors or above in urban areas, on the basis of the current provincial financial subsidy of 654.38+10,000 yuan for each eligible elevator installation project, the municipal financial subsidy of 200,000 yuan/set is used for elevator installation, and the district financial subsidy can be rewarded according to the actual situation. If the installation cost is less than 300,000 yuan/set, it will be subsidized according to the actual construction cost. Appropriate subsidies can be given to families with special difficulties according to relevant regulations. Encourage social capital to participate in the installation of elevators in existing houses. Encourage enterprises and institutions to co-ordinate funds to install elevators in self-managed employee houses.

(1) full consultation
When installing elevators in existing houses, all the owners of the unit, the building or the residential area should fully negotiate and agree to properly handle the adjacent relationship, and the owners whose exclusive parts account for more than two-thirds of the total construction area and more than two-thirds of the total number should issue written consent.
(2) Make plans
The implementation subject entrusts a professional organization to carry out safety inspection and appraisal on the original structure of the residential building where the elevator is installed, and can only entrust a qualified design unit to carry out special design after issuing relevant inspection and appraisal reports. The design unit shall design according to the appraisal report to ensure the safety of elevator installation. The special design shall meet the requirements of architectural design, structural safety, fire safety, special equipment, water, electricity and heating. , including the feasibility assessment report of elevator installation, design and construction scheme, capital budget and cost raising scheme, and elevator later operation and maintenance configuration scheme.
(3) Publicity of the agreement
When installing elevators in existing houses, an elevator installation agreement should be signed with the consent of the relevant owners. The agreement needs to specify the entrusted agent for installing the elevator and its main responsibilities, the fund budget and cost raising scheme, the elevator operation and maintenance cost sharing scheme, and the elevator use management unit after installation.
The implementer shall publicize the agreement and scheme at the entrance of the building where the elevator unit is to be installed and the bulletin board of the community. And the publicity time shall not be less than 7 days. If there is any objection during the publicity period, an application for mediation can be submitted to the local community neighborhood committee. At the request of the applicant, the community neighborhood committee will organize mediation to urge the relevant owners to voluntarily reach a mediation agreement on the basis of equal consultation.
(4) Joint review
The implementer applies for elevator installation to the leading group of existing residential buildings in the local government (hereinafter referred to as "District Elevator Group"), and provides relevant copies of the owner's ID card and house ownership certificate, agent's ID card and power of attorney, elevator installation scheme text, construction drawing design unit commitment letter, elevator installation agreement and other materials.
District Elevator Group convened departments involved in housing construction, market supervision, industrial information, natural resources, planning supervision, urban management, emergency, real estate, gardens and other relevant pipeline units to jointly review the elevator installation agreement and related programs, and issued joint review opinions. The existing residential buildings facing the street are equipped with elevators. Before the joint trial of the elevator group in the district, the written opinions of the municipal administrative examination and approval bureau on the installation of elevators shall be sought.
(5) Engineering construction
Before the installation of the elevator, the implementer shall go through the formalities for the commencement of the construction project and the supervision and registration of the quality and safety of the project with the local construction administrative department. The construction unit shall inform the municipal market supervision department of the installation of special equipment, and declare the elevator supervision and inspection to qualified special equipment inspection and testing institutions. The construction process is subject to the quality and safety supervision of the special equipment safety supervision and management department and the construction project quality and safety supervision department.
(6) Completion acceptance
After the completion of the project, the implementer will submit a joint acceptance application to the district ladder group with the completion acceptance report and elevator use registration certificate. The district ladder group called the relevant departments of housing construction, market supervision, industrial credit, natural resources, planning supervision, urban management, emergency, real estate, gardens and other street communities for joint acceptance, and issued joint acceptance opinions.
(seven) apply for subsidies
After the joint acceptance, the implementation unit may apply for government subsidies to the district ladder group. The district plus ladder group organizes the application and disbursement of government subsidy funds in a unified way.
Relevant requirements of intransitive verbs
(1) safety requirements
The design, construction and supervision units for installing elevators in existing houses shall have corresponding qualifications. The installed elevator shall conform to the requirements of the Law of the People's Republic of China on Safety of Special Equipment and relevant standards and safety technical specifications, be manufactured and installed by qualified units, and be declared to the local special equipment safety supervision and management department before installation, and be put into use only after passing the supervision and inspection.
(2) Planning requirements
Elevator installation in existing houses should be based on the principle of practicality, and shall not occupy urban roads or affect the implementation of urban planning; We should try our best to reduce the occupation of greening, minimize the adverse impact on adjacent buildings, and not increase or increase living space in disguise. The construction area is not included in the plot ratio, and the occupied land is not included in the building density.
Seven. Organizational leadership and division of responsibilities

The county (city, district) government shall set up a leading group for installing elevators in existing houses, and be responsible for the specific organization and implementation of installing elevators in existing houses within its jurisdiction. Street offices and community neighborhood committees are responsible for the policy propaganda, business guidance and contradiction coordination of elevator installation in existing houses.
Municipal Bureau of Industry and Information Technology, Municipal Urban and Rural Management Bureau, Municipal Emergency Management Bureau, Municipal Real Estate Bureau, Municipal Garden Bureau, Municipal Provident Fund Management Center and other departments and related pipeline units shall, according to the division of responsibilities, support the related work of installing elevators in existing houses according to the principle of streamlining and high efficiency.
Eight. safeguard measure

(three) the municipal special equipment safety supervision and management department shall uniformly publish the list of qualified elevator manufacturing, installation, renovation and maintenance units in the existing houses, so as to facilitate the people to choose independently.
(four) the production, operation, use, maintenance, inspection, safety risk assessment, supervision and management of installed elevators shall be carried out in accordance with the relevant provisions of the Measures for the Administration of Elevator Safety in Taiyuan City.
(five) the existing residential elevator installation should be combined with the actual situation, and actively explore the use of new materials, new technologies and new methods to encourage the purchase of relevant insurance.
This opinion shall come into force as of the date of issuance and shall be valid for 5 years. This opinion applies to the installation of elevators in existing residential buildings in six districts of Taiyuan City, and the installation of elevators in existing residential buildings in three counties and one city can be implemented with reference.
