Interim Measures of Shenzhen Municipality on the Administration of Carbon Emission Trading

Chapter I General Provisions Article 1 In order to build an environment-friendly society, accelerate the transformation of economic development mode, promote energy conservation, emission reduction and green and low-carbon development, establish and standardize the carbon emission trading market, and realize the greenhouse gas emission control targets, these Measures are formulated in accordance with the Regulations of Shenzhen Special Economic Zone on Carbon Emission Management. Article 2 These Measures shall apply to carbon emission trading and its supervision and management activities within the administrative area of this Municipality.

The term "carbon emission trading" as mentioned in these Measures refers to a carbon emission control mechanism in which the Municipal People's Government (hereinafter referred to as the municipal government) sets the total amount of carbon dioxide emissions of carbon emission units and their emission reduction obligations, and carbon emission units fulfill their obligations through market mechanisms, including carbon emission quantification, carbon emission quota and performance declaration, verification, distribution and trading. Article 3 Trading of carbon emission rights shall adhere to the principles of openness, fairness, honesty and credibility, and be subject to social supervision. Article 4 The municipal development and reform department is the competent department of carbon emission trading in this Municipality (hereinafter referred to as the competent department), which mainly performs the following duties:

(1) Formulating plans, policies and management systems related to carbon emission trading and organizing their implementation;

(two) responsible for the total amount of carbon emissions trading and quota allocation scheme;

(three) to determine the control unit of carbon emission trading and supervise its implementation;

(four) to supervise the trading activities of carbon emission rights of relevant entities;

(five) the establishment and management of carbon emission rights registration register and greenhouse gas emission information management system;

(six) overall planning, guidance and coordination of the city's carbon emissions trading. Article 5 The municipal departments of housing, construction and transportation shall be entrusted by the competent authorities to be responsible for the management, supervision and inspection and administrative punishment of carbon emission trading in their respective industries.

The municipal market supervision and management department is responsible for formulating the standards for quantification, reporting and verification of greenhouse gas emissions in the industrial field, organizing the verification of carbon emissions of industrial carbon emission units included in quota management, and supervising and managing the carbon verification institutions and inspectors in the industrial field; The municipal statistics department is responsible for organizing the accounting of the relevant statistical index data of carbon emission units in industrial sectors that are included in the quota management, and supervising and managing the statistical index data verification institutions.

Finance, finance, economic and trade information, scientific and technological innovation, taxation, environmental protection, land planning, transportation, water and other district governments and functional departments. Responsible for the management of carbon emission trading within their respective responsibilities.

Power supply, gas supply and other units should actively cooperate with relevant departments to do a good job in carbon emission trading. Article 6 The competent department shall, jointly with relevant departments, establish a unified information management system for greenhouse gas emission in the whole city, improve the informatization level of greenhouse gas emission management, and keep abreast of the dynamics of greenhouse gas emission in the whole city.

The competent department shall, jointly with relevant departments, establish a public service platform website for carbon emission trading, and timely disclose and disclose relevant management information of carbon emission trading. Article 7 The competent department shall explore the establishment of a unified, open, open and transparent regional carbon emission trading market. Article 8 The municipal government shall commend and reward the institutions and individuals that have made outstanding contributions to the carbon emission trading in this Municipality. Article 9 Competent departments and relevant departments shall regularly carry out publicity and training on carbon emission trading, and encourage and support units and individuals to participate in carbon emission trading.

Encourage the establishment of carbon emission trading industry associations. Carbon emission trading industry associations should strengthen industry self-discipline, publicize and popularize relevant knowledge of carbon emission trading, and promote energy conservation and emission reduction. Chapter II Quota Management Article 10 This Municipality shall control the total amount of carbon emission trading targets. The target total emission of the carbon emission trading system in this Municipality (hereinafter referred to as the target total emission) shall be set scientifically and reasonably according to the binding indicators determined by the state and Guangdong Province, combined with the economic and social development trend of this Municipality and the carbon emission reduction potential. Eleventh meet one of the following conditions of carbon emission units (hereinafter referred to as control units), the implementation of carbon emission quota management:

(1) Enterprises with carbon emissions of more than 3,000 tons of carbon dioxide equivalent in any one year;

(two) the owners of large public buildings and office buildings of state organs with a construction area of more than ten thousand square meters;

(3) Carbon emission units that have been voluntarily joined with the approval of the competent authorities and incorporated into the carbon emission control and management;

(four) other carbon emission units designated by the municipal government.

The municipal government can adjust the scope of control units according to the needs of energy conservation and emission reduction work in this Municipality and the development of carbon emission trading market. After the list of control units is approved by the municipal government, it will be published on the portal website of the municipal government and the competent department and the website of the public service platform for carbon emission trading. Article 12 Control units shall fulfill their obligations of carbon emission control. If the control unit is the owner of the building, its carbon emission control obligations can be entrusted to the building users and property management units to perform on their behalf. Article 13 An enterprise whose carbon emission exceeds 1000 tons but is less than 3000 tons of carbon dioxide equivalent in any one year shall report its carbon dioxide emission to the competent department every year, and the specific requirements shall be implemented with reference to the control unit.

The municipal government may, according to the needs of the work, gradually incorporate the units specified in the preceding paragraph into the quota management. Article 14 The competent department shall comprehensively determine the annual quota of the carbon emission trading system of this Municipality (hereinafter referred to as the annual quota) according to the total emission target, industrial development policy, industrial development stage, emission reduction potential, historical emission and emission reduction effect.
