These Measures shall come into force from June 65438+10+July 2022, and shall be valid for 5 years.

Article 19 of the Measures for the Administration of Residential Facilities for the Elderly in Huizhou is divided into four aspects: general rules, planning and construction, acceptance and handover, and use management.

The "Measures" require that new residential areas should be equipped with old-age service facilities according to the standard of not less than 20 square meters per 100 households and the minimum indoor area of not less than 100 square meters. Small residential development projects can be appropriately concentrated in neighboring areas.

Where the old-age service facilities in the built urban areas are insufficient, the county and district governments where they are located should strengthen overall coordination, according to the standard of not less than 15 square meters per 100 households and the minimum indoor area of not less than 100 square meters.

Old-age service facilities should be arranged on the first floor of a building or on a floor continuous with the first floor. If it is arranged on a continuous floor, the area of the first floor should not be less than 100 square meter, and it should not be arranged in the basement, semi-basement and mezzanine of the building.

Old-age facilities in new residential areas should be planned, built, accepted and delivered at the same time with residential projects. New residential projects developed by stages, with the construction of old-age service facilities should be arranged in the first phase of construction acceptance, not split.

Use and management: It is clear that the old-age service facilities can be socialized by means of unified operation of state-owned enterprises and cooperation between government and social capital. On the basis of ensuring the demand for public welfare and inclusive services, operators can carry out market-oriented operations according to actual conditions; Old-age service facilities shall not be leased, transferred or mortgaged, and shall not be occupied, damaged or dismantled without authorization.

Measures for the administration of old-age facilities in residential areas of Huizhou City

Article 1 In order to standardize the planning, construction, acceptance, transfer and use management of the old-age service facilities in residential areas, actively respond to the aging population and promote the high-quality development of the old-age service in Huizhou, according to the Opinions of the General Office of the State Council on Promoting the Development of the Old-age Service (Guo Ban Fa [2019] No.5) and the Guiding Opinions of the Ministry of Natural Resources on Strengthening Planning and Land Security to Support the Development of the Old-age Service Industry (Natural Resources Regulation [2066]

Article 2 These Measures shall apply to the planning, construction, acceptance, transfer and use management of old-age service facilities in residential areas of the whole city.

Article 3 Service facilities for the aged refer to houses and facilities that provide life care, rehabilitation care, trusteeship care and medical and health services for the elderly. The facilities for the aged care in residential areas are mainly used for the aged care in home communities.

Article 4 The construction of old-age service facilities in newly-built residential areas shall conform to the local regulatory detailed planning and special planning for the construction of old-age service facilities. According to Code for Planning of Urban Public Facilities (GB50442-2008), Code for Planning of Urban Pension Facilities (GB50437-2007), Standard for Planning and Design of Urban Residential Areas (GB50 180-20 18) and Standard for Architectural Design of Pension Facilities.

Fifth new residential areas should be built according to the standard of not less than 20 square meters per 100 households and the minimum indoor area of not less than 100 square meters. Small residential development projects can be appropriately concentrated in neighboring areas.

Article 6 Where the old-age service facilities in the built urban areas are insufficient, the county and district governments where they are located shall strengthen overall coordination and make overall planning and allocation through new construction, reconstruction, purchase, replacement and lease. According to the standard of not less than 15 square meter per 100 households and the minimum interior area of not less than 100 square meter, or combined with urban function optimization and organic renewal.

Seventh new residential areas with the construction of old-age service facilities meet the requirements of the Architectural Design Standard for Old-age Service Facilities (JGJ450-20 18):

(a) the location should be close to the community square, green space and other public spaces, which is convenient for the elderly to access and serve the elderly in the area. It should be planned together with other community public service facilities such as community management, health, culture, education, sports and fitness.

(2) It should be arranged on the first floor of the building or on the floor continuous with the first floor. If it is arranged on a continuous floor, the area of the first floor should not be less than 100 square meter, and it should not be arranged in the basement, semi-basement and mezzanine of the building. The main entrances and exits should be set separately, with a width of not less than 3 meters, and should be equipped with barrier-free facilities and connected with municipal roads.

(3) The facilities provided for the elderly shall meet the standard that they can be put into use after simple decoration, except that they have passed the acceptance inspection according to law: the walls are white, the cement floor is flat, the doors, windows and toilets are perfect, the water, electricity, gas and barrier-free facilities are complete, and ports such as wired telephone, cable TV and broadband network cable are reserved, which have normal use functions.

(four) the indoor clear height of the house at the time of handover is not less than 2.7 meters.

(five) the configuration of fire control facilities should comply with the relevant provisions of the Code for Fire Protection Design of Buildings, and the fire resistance rating of buildings should not be lower than Grade II.

Eighth new residential areas with the construction of old-age service facilities should be synchronized with the residential project planning, synchronous construction, synchronous acceptance, synchronous delivery. New residential projects developed by stages, with the construction of old-age service facilities should be arranged in the first phase of construction acceptance, not split.

Article 9 Where the transfer of residential land involves the construction of old-age service facilities, the conditions and requirements for the construction and transfer of old-age service facilities shall be specified in the land transfer announcement. The competent department of natural resources will inform the old-age service department at the same level in writing about the land transfer and the construction of old-age service facilities every six months.

Article 10 The competent department of natural resources shall, when examining the design scheme of the construction project of new residential projects, include the planning and design conditions and the requirements of the contract for the assignment of the right to use state-owned construction land in the scope of examination. Article 12 The construction unit shall, in accordance with the contract for the assignment of the right to use state-owned construction land, hand over the allocated old-age service facilities to the local township government (street office) for use according to the planned purpose, and the township government (street office) may entrust the county and district head service departments to make overall use according to the planned purpose.

Thirteenth residential old-age service facilities do not belong to public buildings in residential areas. Real estate surveying and mapping institutions shall independently measure the area of old-age service facilities when conducting the first registration ownership survey, and the ownership survey report shall indicate the real estate unit corresponding to the old-age service facilities. When the construction unit applies for the first registration of the real estate of the old-age service facilities in the residential area, it can jointly apply for the transfer registration of real estate with the local township government (street office). The construction unit that is not handed over in time will be included in the blacklist of dishonesty, and joint punishment will be implemented according to the law or restrictions will be imposed on the subsequent development and construction of other projects by the construction unit. Fourteenth residential property management fees for the construction of old-age service facilities are determined with reference to the ordinary housing standards of residents.

Fifteenth to encourage the unified operation of state-owned enterprises, government and social capital cooperation and other ways to carry out social operation, improve the utilization efficiency and service quality of old-age service facilities.

Sixteenth county and district governments should strengthen the organization and leadership of the planning, construction, transfer and use management of old-age service facilities in residential areas. County and district service departments should perform their supervisory duties and strengthen the guidance and supervision of the operation of old-age service facilities in residential areas. Natural resources, housing and urban construction, township governments (street offices) and other relevant units should conscientiously perform their duties and strengthen coordination and cooperation.

Seventeenth old-age service facilities built in residential areas must be used to provide all kinds of old-age services, and shall not be leased, transferred or mortgaged, and shall not be occupied, damaged or dismantled without authorization.

Eighteenth relevant departments at all levels and the construction unit failed to perform their duties, resulting in the old-age service facilities that should be built but not built or the old-age service facilities do not meet the construction standards and requirements, and the relevant responsible persons shall be investigated for their responsibilities according to law.

Article 19 These Measures shall come into force from June 65438+10+July 2022, and shall be valid for 5 years.
