Interim Measures of Anshan Municipality on Property Management of Urban Residential Quarters

Chapter I General Provisions Article 1 In order to strengthen the property management of urban residential quarters, ensure the rational use of residential quarters, create a beautiful, clean, comfortable and safe living environment for residents, and promote the healthy and orderly development of property management, these measures are formulated in accordance with the relevant provisions of the state and the province and combined with the actual situation of our city. Article 2 The term "residential quarters" as mentioned in these Measures refers to residential quarters with a certain scale and relatively complete infrastructure (including residential quarters and residential groups, hereinafter referred to as residential quarters).

The term "property" as mentioned in these Measures refers to all kinds of houses and their ancillary facilities, equipment, sites and environment that have been completed and put into use.

Residential property management refers to the activities of property management companies to manage and serve residential property by signing contracts entrusted by residential management committees (hereinafter referred to as management committees) or property owners. Third new residential areas must implement unified property management according to the provisions of these measures. Before the implementation of these measures, the residential quarters that have been accepted and delivered for use shall gradually implement property management in accordance with these measures. Article 4 Anshan Real Estate Management Bureau is the competent department of property management in Anshan urban residential areas.

The responsibilities of the property management department of residential quarters are: to be responsible for the organization, coordination and business guidance of the property management of residential quarters, to formulate specific policies and management norms for the property management of residential quarters, and to supervise and inspect the management and service work of the management committee. Responsible for the qualification examination of property management enterprises, the issuance and annual inspection of qualification certificates of property management enterprises.

Planning, urban construction, public security, public utilities, posts and telecommunications, electric power, industry and commerce, price and other departments at all levels shall, in accordance with their respective responsibilities, assist the competent department of residential property to strengthen the property management of residential quarters. Article 5 The property management of residential quarters shall combine the autonomy of owners with the professional services of property management companies, and implement socialized, professional and enterprise management.

The residents' convention formulated by the residential community is binding on the property owners and users in the community. Chapter II Property Management Institutions and Responsibilities of Residential Quarters Article 6 When the occupancy rate of each house in a residential quarter reaches 30%, the property owner shall elect a property management team (odd number of three or more) to be responsible for the management of the house.

When the residential area is delivered for use and the occupancy rate reaches more than 50%, the competent property department of the residential area shall, jointly with the subdistrict office and the residential area development and construction unit, hold the first residential area owners' meeting in time and elect the management committee. Seventh owners' congress is composed of representatives of the owners of this residential area.

Owners' meeting must be attended by owners who hold more than half of the voting rights. The owner may entrust an agent to attend the owners' meeting, and the owner under the age of 18 shall be represented by his legal representative. Article 8 The owners' meeting shall be convened by the CMC at least once a year. The management committee is responsible for delivering the date and contents of the owners' meeting to each owner's representative seven days before the meeting.

Upon the proposal of the owners who hold more than 10% of the voting rights, the management committee shall convene the owners' meeting according to the purpose specified by the management committee within 14 days after receiving the proposal. Article 9 The decision of the owners' meeting shall be adopted by more than half of the voting rights held by the owners' representatives present at the meeting. Article 10 The functions and powers of the owners' congress:

(a) to elect and recall members of the CMC;

(two) to supervise the work of the CMC;

(three) to listen to and consider the work report of the CMC;

(four) to decide on major issues involving the interests of the owners in the residential area;

(5) amending the residents' convention;

(six) to change and cancel the inappropriate decisions of the CMC;

(seven) to approve the articles of association of the CMC and the residents' convention. Eleventh members of the CMC are elected by the owners' congress from among the representatives. The director and deputy director of the CMC shall be elected by the CMC from among its members. The number of members of the Management Committee is odd, and may be composed of five to nine people upon the decision of the owners' meeting.

The CMC may employ personnel from police stations, residents' committees and other relevant units as members of the CMC. Article 12 The management committee shall formulate articles of association. The articles of association of the CMC shall be jointly formulated by the members of the CMC and approved by the owners' meeting. Thirteenth management committee elected by the first owners' meeting, submitted to the residential property department for examination. To apply for the establishment of the CMC, it shall submit the articles of association of the CMC, the list of members of the CMC and the certification documents of the office space.

The administrative department in charge of residential property shall, within/0/5 days after receiving the written application, put forward opinions on whether to agree to the establishment of the management committee, and those who fail to put forward opinions within the time limit shall be deemed to agree. Article 14 The term of office of the Central Military Commission is three years, and members may be re-elected. Members of the CMC are part-time, and the director of the CMC can be full-time.

The meeting of the CMC shall be convened by the director of the CMC according to the needs of the work, and the notice of the meeting and related materials shall be delivered to all members seven days before the meeting. When the CMC holds a meeting, it may invite personnel from relevant government departments, residents' committees, property management enterprises and other units and representatives of housing users to attend the meeting as nonvoting delegates. Fifteenth CMC under the supervision of the residential owners' congress, on behalf of the legitimate rights and interests of the owners to exercise the following functions and powers:

(a) to convene and preside over the owners' meeting and report to the meeting;

(two) to formulate the articles of association of the administrative committee and the residents' convention;

(three) hiring a property management company to manage the residential area, and signing a property management contract on behalf of the property owner;

(four) to consider and decide on the use of funds for residential renovation and public facilities;

(five) to review the annual management plan, supporting projects and major maintenance projects of residential areas formulated by the property management company;

(six) put forward the reporting standards for property management service fees in this residential area, and stipulate the charging standards for property management fees formulated by operators;

(seven) to supervise the property management of the property management company in this residential area;

(eight) to urge residents to abide by the housing convention;

(nine) the organization to create excellent residential activities.

The matters specified in items (2), (3), (4), (5) and (6) of the preceding paragraph shall be approved by the owners' congress.
