Chapter VI Legal Responsibility of Interim Measures for the Management of Special Maintenance Funds of Anhui Property

Twenty-ninth in violation of the provisions of these measures, misappropriation of special property maintenance funds, by the local people's governments at or above the county level real estate administrative departments to recover, give a warning, confiscate the illegal income, and may impose a fine of less than 2 times the amount of misappropriation; Property service enterprises misappropriate special maintenance funds for property, and if the circumstances are serious, the qualification certificate shall be revoked by the department that issued the qualification certificate; If the case constitutes a crime, the directly responsible person in charge and other directly responsible personnel shall be investigated for criminal responsibility according to law.

Thirtieth in violation of the provisions of these measures, the use, preservation and verification of special bills for special maintenance funds for property shall be punished in accordance with the provisions of relevant laws and regulations.

Article 31 Where the local people's governments at or above the county level and their real estate administrative departments and property special maintenance fund management institutions violate the provisions of these measures and commit any of the following acts, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) relief of the property owners should deposit special maintenance funds;

(two) failing to collect and manage the special maintenance funds of the property in accordance with the provisions;

(three) misappropriation of special maintenance funds for property;

(four) failing to use special maintenance funds for property supervision in accordance with the provisions;

(five) there are other acts of abuse of power, favoritism, dereliction of duty.
