Is the cemetery permanent?

Buying a cemetery is not permanent.

The term of the right to use a cemetery generally varies according to different regions. If the city has a large population, the death rate in the city will be higher every year. So the utilization rate of the cemetery is very high. In order to improve the utilization rate of cemeteries, the term of urban land use rights is generally about 20 years. After the cemetery has been used for 20 years, the buyer needs to pay the management fee according to the percentage of the purchase price, but it is not called the property fee. The renewal period can be 5 years, 10 years or 15 years.

For those who have not paid the fee after 20 years, the buyer will be informed in time. 20 years does not mean the service life of the cemetery, but the payment period of the tomb protection fee is 20 years. According to the Funeral Management Law, China does not recognize the permanent right to use operating cemeteries.

Cemetery division

The operating cemetery is a cemetery approved by the Civil Affairs Bureau, and the public cemetery is a cemetery approved by the Civil Affairs Bureau to bury the ashes of residents in this area. Operating cemeteries can bury the ashes of the deceased residents in the city, while public cemeteries can only bury the ashes of the deceased residents in local towns. The overall average price of operating cemeteries is higher than that of public cemeteries.

Business cemeteries have official invoices issued by cemeteries, while public cemeteries have receipts, but there is no VAT invoice. The public cemetery needs to be relocated when the country unconditionally requisitions land, and the operating cemetery will not be requisitioned if it has not reached its service life. Therefore, the operating cemetery is more stable than the public cemetery, and it is safer to buy the operating cemetery as much as possible when the budget allows.
