Article 12 of the Regulations on the Implementation of the Labor Contract Law clearly stipulates that the provisions of the Labor Contract Law on non-fixed-term labor contracts and on payment of economic compensation are not applicable to public welfare posts provided by local people's governments at all levels and relevant departments of local people's governments at or above the county level to resettle people with employment difficulties.

The Ministry of Labor and Social Security's Notice on Carrying out the Statistics of the Re-employment of Laid-off Workers (No.4 issued by the Ministry of Labor and Social Security [2003]) defines public welfare posts as "management and service posts that are mainly supported by the government or developed with funds raised by the society and are in line with the public interest".

Public welfare posts refer to non-profit public welfare management and social welfare service posts established by the government with the main purpose of realizing public interests and resettling people with employment difficulties.
