The deposit, use, management and supervision of maintenance funds for after-sale public housing and rental affordable housing shall comply with the relevant provisions of the state. Article 3 Maintenance funds shall be collected in a unified way, stored in special accounts, earmarked for special purposes, agreed by the owners and supervised by the government. Article 4 The competent department of housing and urban construction of the Municipal People's Government shall be responsible for the supervision and management of the maintenance funds of this Municipality. The competent department of housing and urban construction of the people's government at the county level shall be responsible for the daily management of maintenance funds in this area according to their duties.
Finance, auditing, natural resources and planning, market supervision and emergency response departments, neighborhood offices and township (town) people's governments shall, in accordance with their respective responsibilities and the provisions of these Measures, do a good job in the supervision and management of maintenance funds. Article 5 For residential and non-residential buildings with more than two owners in the same property management area, maintenance funds shall be set up in a unified way, and the owners and development and construction units shall deposit the maintenance funds in accordance with the provisions of these Measures. Article 6 The initial maintenance fund shall be calculated according to the following provisions:
(a) equipped with * * * elevator commercial housing, non-rental affordable housing, according to the city's construction and installation project cost per square meter control price of 8%;
(two) commercial housing without elevator, non-rental affordable housing and supporting buildings of commercial housing shall be controlled according to 5% of the cost per square meter of construction and installation projects in this Municipality.
The competent department of housing and urban construction of the Municipal People's Government shall timely release the cost control price per square meter of construction and installation projects. Article 7 The first maintenance fund shall be deposited into the special maintenance fund account at one time in accordance with the following provisions:
(a) the sale of commercial housing, the purchase of commercial housing sales contract before the deposit;
(2) If unsold commercial housing is deposited by the development and construction unit as the owner before the first registration of real estate, and it has not been deposited after the establishment of the owners' meeting, the owners' committee shall notify the development and construction unit to deposit it within 2 months from the date of receiving the notice;
(3) The supporting buildings of commercial housing shall be deposited by the development and construction unit before the first registration of commercial housing real estate;
(four) the expropriated (demolition) resettlement house belongs to commercial housing, and it shall be deposited by the expropriated (demolition) person.
Where the ownership of the house and supporting buildings specified in items (2) and (3) of the preceding paragraph is transferred, the owner shall bear the maintenance funds of the house and supporting buildings.
In the property management area where maintenance funds have been set up outside the circumstances specified in the first and second paragraphs of this article, if the house owner fails to deposit the first maintenance funds, he shall deposit the first maintenance funds in a special account in accordance with the provisions of these Measures.
If the first maintenance fund is not paid in full in accordance with the provisions of these measures, the development and construction unit shall not deliver the house to the purchaser or the expropriated person.
The competent department of housing and urban-rural construction shall, when the development and construction unit and the house owner apply for the first registration or transfer registration of real estate, push the information such as the deposit of maintenance funds to the real estate registration agency as needed. Eighth buildings, housing maintenance fund balance is less than 30% of the first maintenance fund, the owners should be in accordance with the owners' meeting decided to continue to raise funds in a timely manner.
The renewal standard determined by the maintenance fund renewal plan shall not be lower than the first deposit standard stipulated in Article 6 of these Measures. Ninth before and after the establishment of the owners' congress, the owners' congress did not apply for the transfer of self-management maintenance funds, and the maintenance funds were managed by the competent department of housing and urban and rural construction, and the required work funds were included in the fiscal budget at the same level. Article 10 The competent department of housing and urban and rural construction of the Municipal People's Government shall, in accordance with the principles of capital safety, quality service, scientific evaluation and fairness and openness, select commercial banks as the special management banks for maintenance funds in this Municipality (hereinafter referred to as special management banks), and announce them to the public, sign an entrusted management contract according to law, and clarify the rights and obligations of both parties.
The competent department of housing and urban and rural construction shall, in accordance with its management scope and responsibilities, open a special account for maintenance funds in the region in the special account management bank, set up an account in the property management area or building as a unit, and set up a house portal account.
After the establishment of the owners' congress, if it decides to apply for the transfer of self-managed maintenance funds and open a special account, it shall, in accordance with the provisions of the preceding paragraph, select a bank from the banks managing special accounts to open a special account for maintenance funds.
According to the contract, the special account management bank is responsible for the establishment, deposit, use, interest settlement, transfer, settlement, accounting, reconciliation and inquiry of the maintenance fund account, and entrusts a third-party professional organization to provide maintenance fund management and supervision services to the owners, owners' committees, property service enterprises or other managers who apply for the use of maintenance funds (hereinafter referred to as the use applicant). Article 11 With the consent of the owners' meeting, the income from the parts, facilities and equipment used in the property management area belongs to the owners of the scope of use, which can be mainly used to supplement the maintenance funds and be transferred to the relevant owners' sub-accounts.
