Regulations of Huangshi Municipality on the Administration of City Appearance and Environmental Sanitation

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation and build a clean, beautiful and civilized living environment, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the urban built-up areas of this Municipality, the town built-up areas where the county people's governments are located, and the city appearance and environmental sanitation management activities in other areas designated and announced by the people's governments of cities and counties (cities, districts) for urbanization management. Article 3 The work of city appearance and environmental sanitation shall follow the principles of unified leadership, territorial management, regional responsibility and social participation. Article 4 All units and individuals have the right to enjoy a clean, beautiful and civilized city appearance and environmental sanitation, and have the obligation to create and maintain a clean, beautiful and civilized city appearance and environmental sanitation. Should respect the work of city appearance and environmental sanitation staff, and shall not hinder or obstruct their law enforcement or normal operation. Chapter II Responsibilities of City Appearance and Environmental Sanitation Section 1 Government Responsibilities Article 5 The people's governments of cities and counties (cities, districts) (including the Administrative Committee of Huangshi Economic and Technological Development Zone, the same below) shall lead the city appearance and environmental sanitation work within their respective jurisdictions and perform the following duties:

(a) the city appearance and environmental sanitation work into the national economic and social development plan;

(two) the city appearance and environmental sanitation funds included in the fiscal budget at the corresponding level;

(three) the establishment of city appearance and environmental sanitation management coordination mechanism, study and solve major problems;

Sixth city and county (city, district) urban management department is responsible for the management of city appearance and environmental sanitation in this area, and performs the following duties:

(a) in conjunction with the natural resources and planning, ecological environment, housing and urban and rural construction, water conservancy and lakes and other departments, the preparation and implementation of the area of city appearance and environmental sanitation special planning;

(two) to organize the formulation and implementation of environmental sanitation facilities construction management plan;

(three) the use of urban appearance and environmental sanitation digital management system, the establishment of intelligent operation, grid management, regular inspections and complaints, work linkage and other mechanisms;

(four) to investigate and deal with violations of the provisions of the city appearance and environmental sanitation management;

(five) the establishment of city appearance and environmental sanitation management emergency handling mechanism, do a good job in emergency handling;

(six) to urge the relevant units to implement the labor security of sanitation workers, improve the working conditions of sanitation workers, and ensure the labor safety of sanitation workers;

(seven) to promote the use of advanced technology and equipment, improve the scientific and professional level of city appearance and environmental sanitation work.

The municipal urban management department shall, jointly with the market supervision and management department, formulate urban appearance standards and environmental sanitation standards according to relevant standards and regulations, and report them to the Municipal People's Government for approval before promulgation and implementation. Article 7 Departments of development and reform, education, economy and informatization, public security, finance, resources and planning, ecological environment, housing and urban and rural construction, transportation, water conservancy and lakes, culture and tourism, health and hygiene, market supervision and management, government services and big data management shall, according to their respective functions and duties, do a good job in the management of city appearance and environmental sanitation. Eighth street offices and Township People's governments shall do a good job in the management of city appearance and environmental sanitation in their respective jurisdictions, and urge the implementation of the responsibility area system. Section 2 Responsibility Zones and Responsible Persons Article 9 This Municipality implements the system of responsibility zones for city appearance and environmental sanitation. The area of responsibility for city appearance and environmental sanitation shall be delineated and announced by the urban management department of the county (city, district) in conjunction with the subdistrict office and the Township People's government. Tenth city appearance and environmental sanitation responsible person shall be determined in accordance with the following provisions:

(a) primary and secondary roads, by the local county (city, district) urban management department is responsible for; Outside the primary and secondary roads, the responsible person is the local sub-district office and the Township People's Government;

(two) railways, urban rail transit, stations, docks and their jurisdiction, the responsible person is its manager;

(three) parks, squares, trails, cultural relics protection units, industrial heritage protection areas and other public places, the responsible person is its manager;

(four) rivers, lakes, reservoirs and other public waters, the responsible person is its manager;

(five) the implementation of property management in residential areas, the responsible person is the property service person; For residential areas without property management, the responsible person is the local neighborhood office and the Township People's Government;

(six) organs, institutions, organizations and other units and their management areas, the responsible person is their managers;

(seven) the production and business premises and their management areas, and the responsible person is the manager;

(eight) the responsibility for construction land is the construction unit, the responsibility for land reserve is the main body of land reserve implementation, and the responsibility for land to be built and other plots is the land use right holder;

(nine) environmental sanitation facilities, the responsible person is the manager.

In addition to the provisions of the preceding paragraph, the owners of other buildings (structures) or facilities and places are responsible persons.

In accordance with the provisions of the first and second paragraphs, the responsible person cannot be determined, and it shall be determined by the urban management department of the county (city, district) where it is located.
