Is the contract signed by the individual affiliated with the property company valid?

Property service contracts signed by property companies and some owners are invalid.

China's contract law stipulates that property contracts are anonymous contracts or collective contracts. In the early stage, the property management company signed with the developer, the owners' meeting was established, and the property service contract of the property management company was signed with the industry Committee. Individuals and individual owners have no right to sign property service contracts, and can only ratify previous contracts and management services of previous property companies. It is illegal for individual owners to hire and dismiss the original property company without authorization.

According to the property management regulations, the owners' meeting must be established, and more than half of the owners and more than half of the special parts agree with the industry Committee before signing the property service contract with the property company. Otherwise, the contract is invalid, the housing management and price departments will not put it on record, and the court cannot safeguard the legitimate rights and interests of the property company in contract disputes.
