Measures of Guang 'an Municipality on the Supervision and Administration of Elevator Safety

Article 1 In order to strengthen the supervision and management of elevator safety, prevent and reduce elevator accidents, and ensure personal and property safety, these Measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, the Regulations on Safety Supervision of Special Equipment, the Measures for Supervision and Management of Elevator Safety in Sichuan Province and other laws, regulations and rules, combined with the actual situation of Guang 'an City. Article 2 Whoever engages in elevator production, use, maintenance, inspection, emergency response, safety technical evaluation, supervision and management within the administrative area of this Municipality shall abide by the laws, regulations, rules, standards and norms related to elevator safety and these Measures. Article 3 The people's governments at the municipal and county levels shall strengthen their leadership over elevator safety work, establish a joint meeting system for elevator safety management, coordinate and solve major problems in elevator safety management in a timely manner, and incorporate elevator safety supervision and management funds into the fiscal budget at the corresponding level according to law.

The people's government of a township (town) and the subdistrict office shall assist the relevant administrative departments to investigate the hidden dangers of elevator safety, handle elevator-related complaints, and urge the elevator owners and relevant units to implement elevator maintenance, repair and renovation and fund renewal. Article 4 The market supervision department shall be responsible for the supervision and management of elevator safety within its administrative area, establish a platform for elevator safety supervision and management, coordinate and command elevator emergency treatment and rescue in a unified way, and incorporate the information of elevator safety supervision and management law enforcement into the credit system and publicize it according to law.

The housing and urban-rural construction department is responsible for supervising the elevator configuration design of housing construction and municipal infrastructure projects, and the engineering quality of elevator machine room, shaft and pit.

The Ministry of Economic Information Technology is responsible for promoting the construction of elevator shaft communication network coverage.

Natural resources planning, urban management and law enforcement, education and sports, public security, transportation, commerce, culture, radio, film and television tourism, health emergency and other departments shall supervise and manage elevator safety in accordance with their statutory duties. Article 5 Market supervision departments, elevator users, press, publication, radio, film and television units shall strengthen elevator safety publicity and education, popularize elevator safety knowledge, advocate civilized use of elevators, and enhance the public's elevator safety awareness and self-protection ability. Article 6 The elevator industry association shall strengthen industry self-discipline, carry out industry information analysis and research, organize industry exchange, publicity and consultation, and improve industry service level and elevator safety level. Article 7 Encourage and support the research, popularization and application of new technologies for elevator safety production and management, and improve the safe operation level of elevators. Eighth schools, hospitals, stations, airports, shopping malls, stadiums, exhibition halls, theaters and other public places should be insured with elevator safety liability insurance. Article 9 Any unit or individual has the right to complain and report the illegal acts involving elevator safety to the market supervision department, and the department that receives the complaint and report shall handle it in time according to law. Article 10 The installation, modification and maintenance of elevators must be carried out by elevator manufacturers or their entrusted units that have obtained corresponding licenses in accordance with the Law of the People's Republic of China on Safety of Special Equipment.

If the original elevator manufacturing unit no longer has the corresponding qualification or the legal person qualification is terminated, the user unit shall entrust other units that have obtained the corresponding license to carry out transformation and maintenance. Eleventh elevator renovation and maintenance units shall comply with the following provisions:

(a) to ensure the quality and safety performance of the elevator after construction, and the parts provided meet the requirements of laws, regulations, safety technical specifications and manufacturing standards;

(2) Providing design documents, product quality certificates, operation and maintenance instructions, type test certificates and other relevant safety technical data and documents that meet the requirements of safety technical specifications;

(3) The warranty period of elevator parts, safety accessories and safety protection devices replaced in overhaul projects shall be specified. In case of quality problems during the warranty period, the warranty obligations shall be fulfilled in accordance with regulations and agreements, and elevator parts, safety accessories and safety protection devices shall be repaired or replaced free of charge. Twelfth elevator users are determined according to the following provisions:

(a) the newly installed elevator has not been delivered for use, and the construction unit is the elevator user;

(two) the elevator management entrusted by the property service enterprise or other managers, and the main body of the entrusted management is the elevator users;

(3) If there is only one owner of the elevator that is not managed by the realty service enterprise or other managers, the owner is the elevator user; If there are multiple owners, the elevator users shall be determined through consultation; If the negotiation cannot be determined, the local township (town) people's government and the street office shall coordinate to determine that one of the owners is responsible for the safe use and management of the elevator, and other owners shall bear joint and several liability;

(4) If the owner of the house and other places equipped with elevators rents, lends or otherwise transfers the right to use the house and other places, the elevator user shall be stipulated in the contract; If there is no agreement or the agreement is unclear, the owner of the elevator is the elevator user;

(five) the elevator funded by the government, the manager entrusted or designated by the government is the elevator user.

If the elevator does not clearly use the unit, it shall not be put into use. Thirteenth elevator users should apply to the market supervision department for registration before or within 30 days after the elevator is put into use, and obtain the registration certificate.

If the elevator is stopped for more than one year or the stop period exceeds a regular inspection cycle, the elevator user shall seal the elevator and set warning signs, and go through the stop procedures with the original use registration authority within 30 days; If it is re-enabled, the user shall conduct a self-inspection of the elevator and go through the activation procedures at the original use registration authority; If the period of validity of the periodic inspection exceeds, the inspection shall be carried out in accordance with the relevant requirements of the periodic inspection.

If the elevator use unit changes, the original elevator use unit shall go through the handover procedures to ensure the complete handover of safety technical files and work; The new elevator user shall, within 30 days from the date of change, go through the formalities of change at the original use registration authority.

If the elevator is scrapped, the elevator user shall go through the cancellation procedures with the original use registration authority within 30 days from the date of scrapping.
