Is it illegal to cut off the supply of property?

It is illegal for a property to be blacked out.

When the power generation and power supply system is normal, the power supply enterprise shall continuously supply power to users. Power supply enterprises shall notify users in advance when power supply needs to be interrupted due to maintenance of power supply facilities, power restriction according to law or illegal use of electricity by users.

The owner implements a power outage, usually under the following circumstances:

1. When the owner fails to pay the water and electricity charges and authorizes the property management company to collect and remit them, the water and electricity can be cut off;

2. In case of sudden catastrophic accidents, the property management company has the right to cut off water and electricity;

3. The property also has the right to cut off water and electricity according to relevant administrative orders or upon receiving the notice from the water supply and power supply department. For example, the power supply department should guarantee the power supply line, and when the power outage notice is issued to the public, the property can be blacked out within the specified time;

It should be noted that even if the property has the right to cut off water and electricity, it is because it is authorized. Property companies have no right to cut off water and electricity. The owner pays the property fee according to the property contract signed by both parties, the property company provides property services, and the owner uses electricity and water according to the power supply contract signed with the water supply and power supply company;

Therefore, the property company has no right or authorization to collect water and electricity charges, nor can it cut off water and electricity because the owner does not pay the property fee. Otherwise, if the property management company causes losses to the owners due to unauthorized water and power cuts, it may require them to bear the corresponding liability for damages;

Article 944 of the Civil Code of People's Republic of China (PRC) (1) The owner shall pay the property fee to the property service provider as agreed. If the property service provider has provided services in accordance with the agreement and relevant regulations, the owner shall not refuse to pay the property fee on the grounds that he has not accepted or does not need to accept the relevant property services;

(two) if the owner fails to pay the property fee within the time limit in violation of the agreement, the property service provider may urge him to pay it within a reasonable time limit;

(three) after the expiration of a reasonable period of time, the property service provider may bring a lawsuit or apply for arbitration;

(four) the property service person shall not stop the power supply, water supply, heating, gas supply and other ways to urge the payment of property fees.
