Article 1 Housing conditions

Article 2 Identification process

Article 3 Lease management
(1) Operation service enterprise. (2) Lease method. According to the consultation results between the operation service enterprises and residents, residents can choose to rent their houses directly to tenants who meet the application conditions for renting houses, and the operation service enterprises provide third-party entrusted operation services for residents. Residents can also choose to lease their houses to operating service enterprises and entrust them with leasing operations.
(3) the storage period. Residents' stock housing is used for the management of affordable rental housing, and shall not be listed and traded (including transfer and market lease, etc.). ) within 5 years, and through the housing transaction and real estate registration system to be restricted. The time limit shall be calculated from the date of publication of the Confirmation of Xi Residents' Application for Affordable Rental Housing. Article 4 Application for lease
The applicant applies for the qualification of affordable rental housing in real time according to the housing information released by the "service platform", and the qualification review of affordable rental housing is implemented in accordance with the Interim Provisions on the Qualification Review and Distribution of Affordable Rental Housing in Xi.
If there are multiple applicants for the same house, the operation service enterprise will arrange the house selection in turn according to the examination and approval time until the lease contract is signed.
Article 5 Contract Management
(1) Sign the contract. If the residents choose to operate the service enterprise as a third party, the lessor (property owner), the lessee and the service enterprise shall sign a tripartite housing lease contract through the "service platform", and handle the online signing and filing of housing lease according to relevant regulations.
Residents choose to lease their houses to operating enterprises and entrust them to operate under lease. Both parties signed a house lease contract and signed it for the record according to the Measures for the Administration of Commercial House Lease. When an operating enterprise sublets the entrusted house to a sublessor, it shall sign a house lease contract in accordance with the relevant provisions and sign it for the record.
(2) Term of the contract. After being included in the management of affordable rental housing, the lease contract period shall not exceed 5 years. Due to the needs of work and life, the lessee may terminate the lease contract in advance after reaching an agreement with the other party to the lease contract, and the defaulting party shall bear the liability for breach of contract in accordance with the agreement in the lease contract.
Article 6 Fees
(1) Rent collection. The rent is charged on a monthly or quarterly basis. The rent for more than 3 months is not charged at one time, and the deposit does not exceed 1 month's rent. Residents who choose to lease their houses to operating enterprises and entrust them to lease operations shall, in accordance with the relevant provisions of the supervision of housing rental funds in our city, include the rent and deposit into the fund supervision account.
(2) Collection of service fees. If the residents choose the operation service enterprise as the third party to entrust the operation, the lessor shall pay the operation service fee to the operation service enterprise after completing the online signing and filing of the house lease in accordance with the contract.
Article 7 charging standards
(1) Rent standard. The rent of affordable rental housing is guided by the government according to the principle of "sustainable rental service enterprises and affordable tenants". The rent standard shall not be higher than 90% of the assessed rent of the market rental housing with the same location and quality.
(2) service fee standard. Operation service enterprises shall publicize the service fee charging standard on the "service platform", and the service fee shall be lower than the industry average standard, and encourage operation service enterprises to lower the service fee standard.
Article 8 Rights and obligations of operating service enterprises
The operation service enterprise shall abide by the relevant provisions of the state, province and city on the affordable rental housing and the relevant commitments in the Commitment Letter of the Affordable Rental Housing Operation Service Enterprise, and perform the relevant rights and obligations in accordance with the provisions of laws and regulations and the contract.

2. Collect service fees according to the operation service agreement;
3. (2) Obligations
1. Responsible for housing verification, housing display, lessee qualification verification, signing and filing, etc.

Article 9 Rights and obligations of the lessor
The lessor shall abide by the relevant provisions of the state, province and city on affordable rental housing and the relevant commitments in the Letter of Commitment on Residents' Voluntary Use of Stock Housing for Affordable Rental Housing, and perform relevant rights and obligations in accordance with the provisions of laws and regulations and the provisions of this Contract.

1. Lease matters can be negotiated with the lessor through the "service platform" according to laws and regulations;
2. Enjoy preferential rent policies for affordable rental housing;
3. Due to the needs of work and life, the operating service enterprise can terminate the lease contract in advance through consultation with the lessor;
4. If the lease term expires and the house continues to be leased, under the same conditions, the original lessee has the priority to lease;
5. Enjoy other rights stipulated by laws and regulations and agreed in the contract according to law.
(2) Obligations
1. Cooperate with operation service enterprises to carry out house leasing;
2. Renting affordable rental housing in accordance with the contract, not engaging in illegal activities in affordable rental housing, and not subletting, lending or subletting the leased housing;
3. Use the house and indoor facilities and equipment reasonably according to the contract, cooperate with the lessor, operation service enterprises and relevant departments to carry out safety inspection, and report the safety hazards such as fire, gas and public security in time, and the corresponding responsible subjects will deal with them according to the regulations and the contract.
4. Pay the rent, water, electricity, gas, internet and property services in time according to the contract, and vacate the leased house in time after the contract is terminated;
5. Fulfill other obligations stipulated by the national, provincial and municipal policies on affordable rental housing.
