Legal subjectivity:

The property company must sign a property contract with the owner: for the project under development and construction, the developer and the property company will sign a formal project "Early Property Management Contract"; For projects with only one or several big owners, the owners will directly sign the formal project of Property Service Contract with the property management company; For projects with multiple owners, the owners' general meeting will make a resolution, and the owners' committee will sign a property service contract with the property company; For residential buildings, property companies do not need to sign property contracts with owners. Because the services provided by property management companies are mainly public areas and public facilities, no owner can be fully responsible for the clients. Therefore, only developers and industry committees can sign property contracts with property companies.

Legal objectivity:

Article 34 of the Regulations on Property Management shall conclude a written property service contract with the property service enterprise selected by the owners' congress. Property service contracts shall stipulate property management matters, service quality, service fees, rights and obligations of both parties, management and use of special maintenance funds, property management premises, contract term, liability for breach of contract, etc.
