The law requires the police to remind that throwing objects at high altitude is a dangerous act. If the circumstances are serious, it can constitute a crime and will be investigated for criminal responsibility.

According to China's Tort Liability Law, if throwing objects from buildings or falling objects from buildings causes damage to others, and it is difficult to determine the specific infringer, in addition to being able to prove that he is not an infringer, the user of the building who may cause damage shall compensate.

The Supreme People's Court issued "Opinions on Properly Handling Cases of Parabolic Objects and Falling Objects from High Altitude" (hereinafter referred to as "Opinions"), and put forward 16 specific measures to effectively prevent and punish crimes of parabolic objects and falling objects from high altitude according to law, and earnestly safeguard people's "overhead safety".

In view of the frequent incidents of throwing objects and falling objects at high altitude in recent years, people's courts at all levels should earnestly implement the people-centered development concept, give priority to safeguarding the legitimate rights and interests of the people, fully understand the social harm of throwing objects and falling objects at high altitude, combine prevention with punishment, strengthen source management, punish crimes according to law, properly handle civil disputes, improve relevant working mechanisms, comprehensively protect people's personal and property safety, ensure people's livelihood and promote social harmony and stability.

It is necessary to clearly distinguish between high-altitude parabolic objects and falling objects, which are very different in the subjective aspect and social harm of the responsible person, as well as in criminal conviction and civil liability investigation. In criminal trials, people's courts should give full play to the deterrent function of punishment and make full use of the existing provisions of criminal law. Whoever intentionally throws objects at high altitude shall be punished for the crime of endangering public security by dangerous means, intentional injury or intentional homicide according to the specific circumstances, and shall be given a heavier punishment according to the specific circumstances; If falling objects from high altitude constitutes a crime, they shall also be convicted and punished according to law. In civil trials, the people's court should comprehensively apply the rules of evidence in civil proceedings to find and determine the direct infringer to the maximum extent, and judge him to bear tort liability according to law; If the realty service enterprise fails to fulfill its statutory or agreed obligations, causing damage to others due to the falling of buildings and their shelving and hanging objects, it shall also be investigated for its tort liability; If the realty service enterprise conceals, destroys, falsifies or refuses to provide corresponding evidence, which makes it difficult to identify the facts of the case, it shall bear the corresponding adverse consequences.

At present, the quality of the public is uneven. If we rely entirely on our self-cultivation and consciousness to avoid throwing objects at high altitude, it is unrealistic to implement the measures at this stage. So how to prevent it?

First of all, increase the patrol and daily publicity and education of residential areas and properties. Through public service advertisements, posters, community publicity, school education, etc. We will step up publicity-including the hazards of throwing objects at high altitude, accident cases and, most importantly, what consequences we will get and what degree of punishment we will receive.

Secondly, increasing the 360-degree monitoring of community video surveillance can better capture the dangerous behavior of which building and which household.

Finally, through legislation, amend relevant laws and regulations, increase the intensity of criminal sanctions and the amount of compensation, so that they dare not throw, do not want to throw. There is nothing more effective than "openness-heavy punishment-openness" when the average education level and average quality of society are insufficient.
