Regulations of Lanzhou Municipality on the Safety Management of Fireworks and Firecrackers (202 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the safety management of fireworks and firecrackers, improve the quality of the atmospheric environment, and ensure the safety of the public, people and property, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the production, operation, storage, transportation, discharge, destruction and disposal of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The safety management of fireworks and firecrackers in this Municipality adheres to the principles of education, guidance, strict control and comprehensive management. Article 4 The people's governments of cities and counties (districts) shall establish a joint meeting system for the safety management of fireworks and firecrackers, which is attended by departments of emergency management, public security, transportation, ecological environment, urban management and market supervision, so as to comprehensively coordinate the safety management of fireworks and firecrackers.

The emergency management department is responsible for the safety supervision and management of fireworks production, operation and storage; The public security department is responsible for the safety management of fireworks transportation, discharge, destruction and disposal. Other relevant departments shall do a good job in the safety management of fireworks and firecrackers in accordance with the division of responsibilities.

Township people's governments and sub-district offices shall incorporate the safety management of fireworks and firecrackers into grass-roots social governance, strengthen organization, coordination, supervision and inspection, and cooperate in the safety management of fireworks and firecrackers. Article 5 State organs, public organizations, enterprises, institutions and social organizations, community residents' committees, villagers' committees, owners' committees and property management enterprises shall assist in the safety management of fireworks and firecrackers in their own units or regions, and publicize, educate and guide citizens to discharge fireworks and firecrackers legally, civilly and safely. Article 6 This Municipality implements a licensing system for the production, operation, transportation, holding of fireworks parties and other large-scale fireworks display activities.

Without permission, no unit or individual may produce, manage, store or transport fireworks, or hold fireworks parties or other large-scale fireworks display activities. Seventh city and county (District) people's government and its relevant departments shall regularly organize fireworks safety management publicity, and increase the publicity of fireworks safety management during major festivals.

Radio, television, newspapers, Internet and other media should carry out the safety management of fireworks and firecrackers and the public welfare propaganda of setting off fireworks and firecrackers in accordance with the law, civilization and safety.

Schools and guardians of minors shall educate minors about the safe discharge of fireworks and firecrackers. Eighth units and individuals are encouraged to report illegal activities in production, operation, storage, transportation, fireworks and other activities to the public security, emergency management and other relevant departments through the alarm telephone, production safety report telephone and citizen service hotline.

Public security, emergency management and other relevant departments shall promptly accept the report, and the processing time for illegal production, operation and storage shall not exceed ten working days, and those who discharge illegally shall promptly rush to the scene to deal with it and reply to the informant; Belonging to the responsibilities of other departments and units, it shall be transferred to the relevant departments and units in a timely manner and inform the informants. Article 9 The varieties and specifications of fireworks and firecrackers allowed to be operated and set off in this Municipality shall be determined by the municipal emergency management department in conjunction with the departments of ecological environment, public security and market supervision, and the product catalogue shall be announced to the public.

It is forbidden to operate, store, transport and set off fireworks and firecrackers not included in the provisions of the preceding paragraph.

Information on illegal production, operation, storage, transportation and discharge of fireworks and firecrackers shall be included in the public credit information service system of this Municipality. Chapter II Safety Management of Production, Operation, Storage and Transportation Article 10 Fireworks and firecrackers production enterprises in this Municipality shall not commit the following acts:

(a) using retired double (multi) base propellant or directly using retired single base propellant to produce fireworks;

(two) the use of potassium chlorate to produce fireworks;

(three) the production of small fireworks, friction, smoke and inner tube combined fireworks and other dangerous fireworks;

(four) the production of other types of fireworks and firecrackers prohibited by laws and regulations or the use of raw materials prohibited by laws and regulations to produce fireworks and firecrackers. Eleventh fireworks wholesale and retail enterprises and outlets, announced to the public by the municipal emergency management department.

City emergency management department is responsible for the approval of fireworks distribution and the issuance and management of wholesale licenses.

The county (district) emergency management department is responsible for the examination and approval of retail business layout and the issuance and management of retail licenses within its administrative area. Article 12 The Chengguan District, Qilihe District, Xigu District and Anning District of this Municipality may set up temporary retail outlets for fireworks and firecrackers upon approval from 23rd to 15th of the twelfth lunar month, and prohibit the sale of fireworks and firecrackers at other times.

Heping town, Zhonghe Town, Jiuhe Town and Shuping Town of Yongdeng County in Yuzhong County shall not set up long-term retail outlets of fireworks and firecrackers in villages near urban areas and along major traffic routes, and set up temporary retail outlets to implement the provisions of the preceding paragraph. The specific scope shall be determined and announced by the Municipal People's Government. Thirteenth without permission, no unit or individual may engage in fireworks wholesale and retail activities.

Fireworks and firecrackers operators shall abide by the safety management regulations, hang their business licenses in a prominent position in the sales place, and sell fireworks and firecrackers in accordance with the prescribed scope, time and place. The purchase and sale of fireworks and firecrackers shall conform to the national safety and quality standards and the varieties and specifications stipulated by this Municipality.

Fireworks and firecrackers shall not be sold to minors or persons with mental disorders or abnormal behaviors.
