Measures of Suqian Municipality on the Administration of Elevator Safety

Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent and reduce elevator accidents, and ensure personal and property safety, these Measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, the Regulations of the State Council on Safety Supervision of Special Equipment and the Regulations of Jiangsu Province on Safety of Special Equipment, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the construction, installation, renovation, use, maintenance, inspection, testing, supervision and management activities of elevator projects within the administrative area of this Municipality.

The term "elevator" as mentioned in these Measures refers to the elevator determined according to the catalogue of special equipment prescribed by the state, including passenger elevators, freight elevators, escalators and moving sidewalks. Article 3 The elevator safety management shall adhere to the principles of safety first, prevention first, clear rights and responsibilities, comprehensive management, convenience and high efficiency. Article 4 The people's governments of cities and counties (districts) shall strengthen their leadership in elevator safety management, guarantee the funds for elevator safety supervision and management, urge relevant departments such as market supervision and management to perform their duties of elevator safety supervision and management according to law, and coordinate and solve major problems in elevator safety supervision and management in a timely manner.

Township people's governments and sub-district offices shall assist in the supervision and management of elevator safety.

Development Zone (Park), tourist resort management agencies in accordance with the responsibilities stipulated by the Municipal People's government to do a good job in the supervision and management of elevator safety in this area. Fifth market supervision and management department is responsible for the supervision and management of elevator safety within their respective administrative areas.

The housing and urban-rural construction department is responsible for the supervision and management of the quality and standards of civil engineering such as elevator shafts, machine rooms and pits in the projects under construction.

The property administrative department is responsible for strengthening the guidance and supervision of the property service enterprises within their respective administrative areas to perform the daily safety operation management duties of elevators according to law.

Finance, development and reform, education, public security, transportation, commerce, industry and information technology, natural resources and planning, culture, radio and television, tourism, health, emergency management, communication industry management, fire rescue and other departments and units. Should be in accordance with their respective responsibilities, do a good job in elevator safety supervision and management. Sixth market supervision and management departments should strengthen the publicity and education of elevator safety knowledge, and enhance the public's awareness of elevator safety and self-protection ability.

Schools, kindergartens and other educational institutions will incorporate elevator safety knowledge into the content of safety education, popularize elevator safety knowledge, and enhance students' and children's awareness of safe and civilized use of elevators.

News media should publicize elevator safety laws, regulations and related knowledge for public welfare. Article 7 Encourage the adoption of new technologies and methods such as big data and Internet of Things, promote the intelligent and information-based development of elevator use, maintenance, inspection and testing, emergency handling and supervision and management, improve the elevator safety management level, and enhance the ability of accident prevention and emergency rescue. Eighth encourage elevator production, use, maintenance and other units to insure elevator safety liability insurance, improve the ability of elevator accident compensation. Article 9 Elevator industry associations shall strengthen industry self-discipline, organize elevator safety training and consulting services, participate in elevator emergency rescue activities, and improve industry service and safety management level. Chapter II Building Installation Article 10 A building engineering design unit shall reasonably design elevator shafts, machine rooms, pits and other building structures according to the use functions and relevant codes and standards of the building, and put forward opinions on the number of elevator configurations and parameters.

Construction drawing review institutions shall, in accordance with relevant regulations and standards, review the selection and configuration of building structures such as hoistways, machine rooms and pits, as well as elevators. Article 11 The construction unit shall, according to the specific provisions on elevator selection and configuration and the opinions of the construction engineering design unit, purchase elevators that are compatible with the building structure and use requirements, meet the relevant national and provincial standards, and meet the requirements of emergency rescue, fire fighting, barrier-free access and smooth traffic.

Before the elevator is delivered for use, the mobile communication signal coverage of the elevator car and shaft should be completed. Twelfth elevator installation and construction units shall comply with the requirements of safety in production at the construction site and take on-site safety protection measures.

The construction unit shall organize the quality acceptance of elevator installation project in accordance with the relevant national standards for elevator construction quality acceptance. Thirteenth elevator shaft, machine room, pit and other civil engineering, anti-leakage warranty period shall not be less than five years, counting from the date of completion and acceptance of the project. Fourteenth construction projects supported by government financial funds should be equipped with elevators, and the elevator room should be equipped with air conditioning. Encourage social investment in construction projects to install air conditioners in elevator rooms. Article 15 When purchasing and installing elevators for construction projects supported by government financial funds, such as government-invested affordable housing and rural housing improvement projects, the relevant departments shall, jointly with the market supervision and management departments, evaluate and demonstrate the safety performance, technical support, failure rate, after-sales service and credit evaluation of elevators to ensure that elevators meet national safety standards. Chapter III Use Management Article 16 Elevator users shall be determined in accordance with the following provisions:

(a) the newly installed elevator has not been handed over to the owner, and the project construction unit is the user;

(2) If the elevator belongs to an owner, the owner is the user;

(3) If the elevators are managed by several owners, the owners shall determine the use unit through written agreement;

(4) If the right to use the place where the elevator is located is leased, lent or transferred by other means, the user may be agreed as the user; If there is no agreement, the elevator owner is the user;

(five) entrusted by the realty service enterprise or other managers, the trustee is the user.

If it is impossible to determine the use unit of the elevator, the township people's government and the sub-district office where the elevator is located shall urge the owner to determine the use unit or designate the use unit.
