Is the property parking charge illegal?

Legal analysis: it is illegal for a property to stop a car owner from going out. The property has no right to restrict the entry of the owner's vehicles, which will infringe on the owner's rights and interests. Because the land ownership of public parking spaces in the community belongs to all owners, the property management office only enjoys the management right, which is given by the owners' Committee. Therefore, it is illegal for property parking to prevent car owners from going out. Car owners can report the situation to relevant departments for help.

Legal basis: The ownership of the parking spaces and garages planned for parking cars in Article 275 of the Civil Law of People's Republic of China (PRC) shall be agreed upon by the parties through sale, gift or lease. Parking spaces that occupy roads or other venues owned by the owner for parking cars shall be owned by the owner.
