Chapter I General Provisions Article 1 In order to strengthen and standardize the property management activities in residential quarters, safeguard the legitimate rights and interests of all parties involved in property management, build a grass-roots governance structure of property management and build a harmonious and livable community, these Regulations are formulated in accordance with the relevant national and provincial laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management activities of residential quarters within the administrative area of this Municipality (hereinafter referred to as property management) and their supervision and management. Article 3 Property management shall follow the principles of Party building leading, owner autonomy, government supervision, professional services, matching quality and price, fairness and openness, and consistency of rights and responsibilities.

Under the leadership of community party organizations, the city has established and improved the grass-roots governance system of residential quarters with the participation of neighborhood (village) committees, owners' committees, property service enterprises and owners, innovated property management methods, and improved the standardization and legalization of property management. Article 4 The municipal, district and county (city) people's governments shall strengthen the organization and leadership of property management, establish and improve the mechanism of division of responsibilities and coordinated supervision among departments, coordinate and solve major problems in property management, and promote all aspects of property management as a whole. Fifth city, county (city) housing and urban and rural construction management department is the property administrative department, responsible for the guidance and supervision of property management activities.

Development and reform, public security, civil affairs, finance, judicial administration, natural resources and planning, ecological environment, drainage, market supervision, city appearance and environmental sanitation, landscaping, public utilities, civil air defense, local financial supervision, fire rescue and other departments shall, according to their respective functions and duties, do a good job in property management guidance and supervision.

Town (township) people's governments and neighborhood offices shall, in accordance with the prescribed duties, incorporate property management into the work system of community governance at the corresponding level, establish and improve the work system, clarify work responsibilities, guide and supervise property management activities within their respective jurisdictions, and undertake responsibilities such as emergency property services.

Neighborhood (village) committees shall support and guide the owners and owners' committees within the property management area under their jurisdiction to carry out property management autonomy activities according to law, and carry out property management-related work in accordance with the prescribed responsibilities. Article 6 County (city), town (township) people's governments and sub-district offices shall establish and improve the property management dispute resolution and contradiction dispute mediation mechanism, play the role of professional mediation organizations and community legal advisers, mediate and resolve contradictions and disputes in property management services in a timely manner, and promote the construction of harmonious communities. Article 7 County (city), town (township) people's governments and subdistrict offices shall guide and encourage relevant units to set up voluntary service organizations for property management according to law, carry out publicity and skills training on relevant laws and regulations on property management, and support volunteer service providers to participate in and assist in the daily inspection and supervision of property management. The voluntary service organization of property management shall include members of the owners' committee and other owners. Chapter II Property Management Areas Article 8 The division and determination of property management areas shall follow the principles of giving priority to planning, perfect functions, clear property rights, relative concentration and easy management.

When reviewing the design scheme of residential construction projects, the natural resources and planning departments shall solicit the opinions of the district and county (city) property authorities on the allocation of facilities and equipment for property and property management.

When applying for a planning permit for residential construction projects, the construction unit shall also apply to the district and county (city) property administrative departments for division and determination of property management areas. District, county (city) real estate administrative departments shall, within 30 days from the date of accepting the application, jointly with natural resources and planning departments, town (township) people's governments and neighborhood offices, determine the division according to factors such as the parcel scope of residential construction land, * * facilities and equipment configuration, building scale and community construction. When dividing and determining the property management area, the opinions of the local residents' (village) committees shall be sought.

Non-residential property and residential property have the same supporting facilities and equipment, and non-residential property should be included in the residential property management area. Under any of the following circumstances, the owners' committee may apply to the property administrative department of the district or county (city) where it is located for adjustment of the property management area upon the decision of the owners' general meeting:

(2) The smaller property management area is merged with the adjacent property management area.

To apply for the adjustment of the property management area, it shall submit the property management area adjustment plan, the property management room and facilities and equipment maintenance management responsibility allocation plan, the decision of the owners' meeting and other materials. The local county (city) property administrative department shall, within 30 days from the date of receiving the relevant materials, make a decision on whether to adjust the property management area in conjunction with the town (township) people's government, neighborhood offices and residents' committees in accordance with the provisions of the preceding paragraph and the first paragraph of Article 8 of these regulations. Decided not to adjust, it shall explain the reasons and basis. Tenth public areas planned as urban roads, urban public green spaces and urban rivers within the property management area do not belong to the scope of property management, and are managed by municipal facilities, urban greening and water administrative departments in accordance with the prescribed division of responsibilities.

Owners * * who are connected with municipal facilities outside the planned construction land, enclosure or fence in the property management area own the site, and the owners * * * jointly decide and implement the management responsibilities, and maintain the city appearance management and environmental sanitation order in accordance with the provisions of laws and regulations on city appearance and environmental sanitation.

Public toilets open to the public in the property management area shall be managed and maintained by the competent department of city appearance and environmental sanitation; The allocation and use management of garbage houses, domestic waste sorting collection points and collection containers shall be implemented in accordance with the regulations of Ningbo Municipality on the management of domestic waste sorting and other relevant laws and regulations.
