What are the conditions for halving the property fee?
1. Inadequate property service: If the service of the property is not in place, the owner can bring a lawsuit to the court and ask for a reduction of the property fee. Because the owner and the property have signed relevant contracts, both parties should fulfill their obligations or responsibilities in accordance with the provisions of the contract. If one party breaches the contract, it can bring a lawsuit. The premise is that the owner must have evidence to prove that the property does have service problems;
2. The property fee can be reduced if the house is vacant for one year: before the establishment of the owners' meeting, the house is still vacant for more than one year after delivery, and the property fee collected during the vacant period should be reduced appropriately. As for the specific fee reduction, the owner and the property need to negotiate;
3. Low-income families in resettlement houses can be exempted from paying property fees: in resettlement houses, low-income families can enjoy full exemption from paying property fees, and other families with incomes below half of the per capita income can also enjoy certain relief policies.
The following eight situations can not pay property management fees:
1, because the house quality problem is not delivered, the property fee shall be paid by the developer;
2. Rent the house, and the lease contract indicates that the property fee shall be paid by the lessee;
3. If the property management company fails to perform the service responsibilities of the contract, all owners can refuse to pay, but there must be strong evidence;
4. The property management company has not signed a contract with the owner;
5. The service quality provided by the property management company can't reach the standard agreed in the contract;
6. The property company does not have the original approval document of the price management department;
7. The property management company expands the charging scope and raises the charging standard without authorization;
8. The property management company increases the charging items without the consent of the owner.
Legal basis: Article 17 of the Measures for the Administration of Property Service Charges.
Within the property management area, water supply, power supply, gas supply, heating, communication, cable TV and other units shall charge relevant fees to the end users. If the property management enterprise accepts the entrustment to collect the above fees, it may charge the entrusting unit a handling fee, and may not charge the owners any additional fees such as handling fees.
