Scope of Prohibiting Fireworks and Firecrackers in Fuyang City

In order to further improve the environmental quality of our city, according to the provisions of the Law on the Prevention and Control of Air Pollution in People's Republic of China (PRC), the Regulations on the Safety Management of Fireworks and Firecrackers, the Regulations on the Prevention and Control of Air Pollution in Anhui Province and the Regulations on the Management of Fireworks and Firecrackers in Fuyang City and Pan Xiang, the relevant matters concerning the prohibition of fireworks and firecrackers in our city and Pan Xiang are hereby notified as follows:

1. Areas where fireworks and firecrackers are prohibited in Fucheng: Xinhua Street and Yuanzhai Town in the east, Ji Cheng Town and Zhong Shi Street in the west, the south bank of Cihuai New River in Zhoupeng Street in the north, and the area surrounded by Wangdian Town and Yuanji Town in the south (see figure). Fireworks and firecrackers are prohibited from being set off throughout the year.

Areas in Fucheng where burning incense on big boards is prohibited: south bank of Cihuaixin River, Wu Town and Yuanzhai Town in Camellia Town in the east, Ninglaozhuang Town, Xihu Town, Ji Cheng Town and Santaji Town in the west, Ninglaozhuang Town in Zhoupeng Street in the north, south bank of Cihuaixin River in Camellia Town, and the area surrounded by Santaji Town, Wangdian Town and Yuanji Town in the south (see figure). It is forbidden to burn large plates of incense all the year round in the no-burn zone.

In addition to the above-mentioned prohibited discharge areas, fireworks and firecrackers are prohibited in the following places throughout the year:

(1) State organs;

(2) cultural relics protection units;

(3) Transportation hubs such as stations, docks and airports and railway line safety protection zones;

(four) the production, storage and business units of inflammable and explosive dangerous goods and their surrounding areas 100 meters;

(5) Within the safety protection zone of power transmission and transformation facilities;

(6) Medical institutions, pension institutions and educational institutions;

(seven) public cultural facilities such as libraries, archives and museums;

(eight) public places of worship such as funeral homes and cemeteries;

(9) Prisons, detention centers, detention centers and drug rehabilitation centers;

(ten) tourist attractions, forest farms, parks, green spaces, nurseries and other key fire prevention areas;

(eleven) shopping malls, bazaars, public places and other crowded places;

(twelve) other places where the people's governments of cities and counties (cities, districts) prohibit the discharge of fireworks.

Second, the people's governments of counties (cities, districts) determine and announce the area and time when fireworks and firecrackers and large incense are prohibited according to local actual conditions.

3. During the early warning period of heavy pollution weather, fireworks and firecrackers and large incense sticks are completely prohibited in the administrative area of Fuyang City.

Four, in the area where fireworks and incense are prohibited, fireworks and incense sales points shall not be set up, and fireworks and incense shall not be sold.

Five, one of the following acts in the forbidden zone, given the following penalties in accordance with the "Fuyang fireworks management regulations" and related laws and regulations:

(a) fireworks are set off in prohibited areas, places or during the early warning period of heavy pollution weather, or in violation of the provisions on the safety management of fireworks and firecrackers, the public security department shall order it to make corrections, and impose a fine on 500 yuan according to Article 15, paragraph 1, of the Regulations on the Administration of Fireworks, Firecrackers and Vegetables in Fuyang City; Those who violate the regulations on public security administration shall be given administrative penalties for public security; If a crime is constituted, criminal responsibility shall be investigated according to law.

(II) In the open air or public * * * areas, or during the early warning period of heavily polluted weather, in accordance with the provisions of the second paragraph of Article 15 of the Regulations on the Administration of Fireworks and Firecrackers in Fuyang City, the urban management law enforcement department shall order it to make corrections and impose a fine of more than 2,000 yuan in 500 yuan; In violation of the provisions of public security administration, the public security department shall give administrative penalties for public security according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

(III) Where fireworks and firecrackers are sold in areas where fireworks and firecrackers are prohibited, according to the first paragraph of Article 16 of the Regulations on the Administration of Fireworks and Firecrackers in Fuyang City, the safety supervision department shall order it to stop the illegal act, impose a fine of more than 20,000 yuan 10000 yuan on wholesale enterprises, and impose a fine of more than1000 yuan and less than 5,000 yuan on retail operators, and confiscate fireworks and firecrackers and illegal income.

(IV) illegal operation of large-scale incense, according to the provisions of the second paragraph of Article 16 of the Fuyang Fireworks and Firecrackers and Large-scale Incense Management Regulations, the market supervision department shall order it to stop the illegal act, impose a fine of more than 2,000 yuan and less than 10,000 yuan, and confiscate the large-scale incense and illegal income.

(five) property service enterprises and operators that provide services such as celebrations, banquets and funerals. Do not discourage or report the discharge of fireworks and firecrackers and large-scale incense in violation of the regulations in the management area, and impose a fine of 1000 yuan to 2000 yuan according to Article 17 of the Regulations on the Administration of Fireworks and Firecrackers and Large-scale Incense in Fuyang City.

(six) fireworks and incense, resulting in property losses of the state and the collective or personal injury or property losses of others, shall bear civil liability according to law.

Six, please the general public consciously abide by the "Fuyang fireworks management regulations" and the relevant provisions of this notice, do not buy, do not set off fireworks, and actively report illegal fireworks to the public security organs (hotline 1 10). Personal report verified, according to the "Fuyang city illegal fireworks report incentives" (Fu Gong Fa [2017] No.4), give the whistleblower 200 yuan reward.
