What if the owner doesn't pay the property fee?

If the owner does not pay the property fee, the property shall be handled as follows:

1. If the owner does not pay the property fee, he can negotiate first;

2. If negotiation fails, and the owner violates the agreement and fails to pay the property fee, the property service provider may urge him to pay it within a reasonable period of time;

3. If the payment is not made within a reasonable period, the property service provider may bring a lawsuit or apply for arbitration;

4. Property service providers shall not stop power supply, water supply, heat supply and gas supply to urge the payment of property fees.

Legal basis: Article 40 of the Regulations on Property Management.

Property service charges should follow the principles of rationality, openness and adaptability between fees and service levels, and distinguish the nature and characteristics of different properties. The owners and the realty service enterprise shall, according to the charging standards for realty service formulated by the competent price department of the State Council in conjunction with the administrative department of construction of the State Council, stipulate in the realty service contract.

What are the rights of property?

1. The preliminary realty service contract signed by the construction unit and the realty service enterprise according to law is binding on the owner;

2. If the owner violates the realty service contract or laws, regulations and management regulations, and implements acts that hinder the realty service and management, and the realty service enterprise requests the owner to bear corresponding civil liabilities such as restitution, cessation of infringement and elimination of obstruction, the people's court shall support it;

3. If the owner refuses to pay the property fee without justifiable reasons or fails to pay the property fee within a reasonable period after being urged in writing, and the property service enterprise requests the owner to pay the property fee, the people's court shall support it;

4. If the owner and the lessee, borrower or other user of the property agree that the property user will pay the property fee, and the property service enterprise requests the owner to bear joint liability, the people's court shall support it;

5. If the realty service enterprise claims the property fee from the owners' committee, the people's court shall inform it to claim the right from the owners who are in arrears with the property fee.
