According to Article 74 of the Property Law of People's Republic of China (PRC), the parking spaces and garages planned for parking cars in the building area should first meet the needs of the owners.

Within the building division, the ownership of parking spaces and garages planned for parking cars shall be agreed upon by the parties through sale, gift or lease. Parking spaces that occupy roads or other venues owned by the owner for parking cars shall be owned by the owner.

The relevant requirements for the ownership of parking spaces stipulate:

1. Underground parking spaces in residential areas should first meet the needs of the owners of residential areas. The ownership of underground parking spaces shall be agreed by both parties through sale, gift or lease. Unless otherwise agreed in the Opinions on Construction Conditions of Real Estate Development Projects, such provisions shall prevail.

2. When a development enterprise sells qualified underground parking spaces, it must post relevant information such as construction project planning permit, state-owned land use certificate, pre-sale permit of commercial housing, pre-sale plan, model text of sales contract, number of underground parking spaces, sales price and so on at the sales place for the record.
