Anhui province elevator safety supervision and management measures

Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent and reduce elevator safety accidents, and ensure personal and property safety, these measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, the Regulations of the State Council on Safety Supervision of Special Equipment and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the production (including design, manufacture, installation, renovation and maintenance), sale, use, maintenance, inspection and supervision of elevators within the administrative area of this province.

The term "elevator" as mentioned in these Measures refers to mechanical and electrical equipment that is driven by power and uses boxes running along rigid guide rails or steps running along fixed lines to lift or transport people and goods in parallel, including manned (cargo) elevators, escalators and moving sidewalks. Article 3 The people's governments at or above the county level shall strengthen the leadership of elevator safety work, establish a coordination mechanism, implement necessary working funds, coordinate and solve major problems in elevator safety supervision and management in a timely manner, and formulate measures for using special residential maintenance funds for the maintenance, renovation and renewal of old elevators.

The agencies of local people's governments, such as township (town) people's governments, subdistrict offices, development zone management agencies, etc., shall, in accordance with their duties, strengthen supervision and inspection on the use of elevators within their respective administrative areas, and assist relevant departments to perform their duties of elevator safety supervision and management according to law. Fourth people's governments at or above the county level shall be responsible for the supervision and administration of special equipment safety (hereinafter referred to as the special equipment safety supervision and administration department).

The administrative department of housing and urban-rural construction (real estate) is responsible for the quality supervision of civil engineering such as elevator machine room, shaft and pit, and is responsible for the supervision and management of special maintenance funds for houses jointly with the financial department.

The public security organ is responsible for investigating and dealing with illegal and criminal acts such as destroying elevator facilities and endangering public safety, and implementing emergency rescue for elevator safety accidents that endanger citizens' personal safety.

The safety production supervision and management department is responsible for the comprehensive supervision and management of elevator safety, organizes or participates in the investigation and handling of elevator safety accidents according to the authorization of the government at the same level, and supervises the implementation of accident investigation and accountability. Article 5 People's governments at or above the county level and their relevant departments, elevator users, schools and news media shall take various forms to strengthen the publicity of elevator safety knowledge and relevant laws, regulations and rules on special equipment, advocate civilized elevator riding, and enhance the public's safety awareness and self-protection ability. Chapter II Production and Sales Article 6 Elevator manufacturing units shall be responsible for the safety performance of elevators.

The installation, modification and maintenance of the elevator shall be carried out by the elevator manufacturing unit or the unit entrusted by it to obtain the corresponding license according to law. Seventh construction engineering design units in the design of elevator devices, should implement the relevant provisions and standards of the state. Do not meet the requirements, the construction drawing review agency shall not issue a review document. Article 8 The construction unit shall purchase elevators according to the elevator setting requirements put forward by the design unit, realize the signal coverage of the public mobile communication network in the elevator car or install the elevator fault monitoring system, and be responsible for handing over the elevator safety technical files to the elevator users. Ninth elevator room, shaft, pit and other civil engineering should meet the national standards and construction engineering design requirements.

If the items listed in the preceding paragraph do not meet the national standards and the design requirements of construction projects, the safety supervision and management department of special equipment shall not handle the registration of elevator use, and the administrative department of housing and urban and rural construction shall not complete the acceptance for the record. Article 10 The elevator sales unit shall establish and implement the system of incoming goods inspection and acceptance, verify the elevator manufacturing license, product quality certificate and other supporting documents, and shall not sell elevators manufactured by units that have not obtained the manufacturing license qualification.

The elevator sales unit shall sign an elevator sales contract with the construction unit or the elevator user unit, and specify the after-sales service content and quality guarantee period. The quality guarantee period shall not be less than 2 years. During the quality guarantee period, the elevator sales unit shall be responsible for free maintenance or replacement of elevator parts, safety accessories, safety protection devices and electrical components in normal use. Article 11 After the elevator is put into use, the elevator manufacturing unit shall conduct follow-up investigation and understanding of its safe operation, and put forward improvement suggestions and provide necessary technical assistance for the problems existing in the maintenance and safe operation of the elevator maintenance unit or the user unit; When a major accident is found in the elevator, it shall promptly notify the elevator user and report to the safety supervision and management department of special equipment. The elevator manufacturing unit shall make a record of the investigation and understanding. Chapter III regards Article 12 elevator users as the main body responsible for elevator safety management and is responsible for elevator safety management. If the elevator does not clearly use the unit, it shall not be put into use.

Elevator use units are determined according to the following rules:

(a) after the installation of the elevator, the construction unit has not been handed over to the owner of the elevator, and the construction unit is the elevator user;

(two) entrusted to the property service unit or other managers for management, the entrusted party is the elevator user;

(3) If there is only one owner of the elevator that is not managed by others, the owner is the elevator user; If there are multiple owners, the elevator users shall be determined through consultation. If the negotiation cannot be determined, the local township (town) people's government and the local people's government agencies such as street offices and development zone management agencies shall coordinate the implementation;

(4) If the building equipped with elevator is used for lease, the parties shall stipulate the elevator user in the lease contract; If it is not agreed, the building owner is the elevator user.

If the elevator user changes, the new elevator user shall handle the change registration formalities in time, and the original elevator user shall provide assistance.
