Measures for the Administration of Shenzhen Baoan International Airport

Chapter I General Provisions Article 1 In order to strengthen the management of Shenzhen Baoan International Airport (hereinafter referred to as the airport), promote the construction and development of the airport, ensure the safe operation and normal order of the airport, and safeguard the legitimate rights and interests of the stationed units, passengers and shippers, these Measures are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Measures shall apply to airport areas and management activities related to airport operation, such as planning and construction, safe operation, clearance protection and environmental protection, unless otherwise stipulated by laws and regulations. Article 3 The meanings of the following terms in these Measures:

(1) Airport management organization refers to the legal person organization established in accordance with the Company Law of People's Republic of China (PRC) to be responsible for the daily operation and management of the airport, namely Shenzhen Airport (Group) Co., Ltd.;

(2) Airport area refers to the airport special area determined according to the urban planning, including the area within the airport fence, fence or other fence facilities and the area outside the city terminal;

(3) Land for airport planning refers to the land demarcated according to law in the approved airport master plan, including land for navigation and communication stations (stations) and related ancillary facilities;

(4) Airport control area refers to the non-public area in the airport where access is restricted according to security needs, including waiting isolation area, aircraft activity area and other areas;

(5) Airport clearance refers to the spatial scope and environmental requirements of the airport communication and navigation station (station) defined according to the requirements of airport obstacle limit map stipulated by civil aviation laws, regulations and civil aviation technical standards in order to ensure the operation safety of civil aircraft;

(6) Resident units refer to government departments, relevant enterprises, institutions and other organizations engaged in air transportation, management and services at airports. Article 4 The Shenzhen Municipal People's Government (hereinafter referred to as the municipal government) shall incorporate the airport construction and development into the national economic and social development plan and be responsible for organizing its implementation.

Shenzhen Airport Management Committee (hereinafter referred to as the Airport Committee) is established by the municipal government, and an office under the Airport Committee (hereinafter referred to as the Airport Office) is responsible for the unified management of the airport and organizing the implementation of these measures.

The relevant functional departments of the district government and the municipal government where the airport is located shall, in accordance with their respective responsibilities, coordinate the implementation of these measures.

Under the guidance of the Airport Committee and its office, the airport management agency shall be responsible for the daily operation and management of the airport, and exercise relevant management functions and powers in accordance with these Measures. Article 5 The airport is a social public welfare infrastructure, and the municipal government shall formulate corresponding industrial policies to encourage and ensure the balanced and coordinated development of the social and economic benefits of the airport.

Airport management activities should be in accordance with the principle of safety first, quality service and normal flight, strictly abide by relevant laws, regulations and rules, accept the supervision and management of the competent civil aviation authorities and the municipal government, and provide fair and just services for air transport enterprises, other on-site units and the public. Article 6 The airport management agency shall be responsible for the operation and management of the airport, and the municipal state-owned assets supervision and administration agency shall be responsible for the supervision and management of the state-owned assets of the airport management agency. Chapter II Institutions and Duties Article 7 The Municipal Airport Committee shall exercise the following duties in accordance with these Measures:

(a) to consider the strategic objectives, overall planning and major policies to promote airport construction and regional aviation industry development, and report them to the municipal government for approval;

(two) to study the relationship with the surrounding airports and coordinate the connection between the airport navigation airspace and the surrounding airports;

(3) Coordinating the relationship between airport development and national civil aviation departments and other state departments; Coordinate the relationship with relevant international civil aviation organizations and institutions in airport development;

(4) To be responsible for coordinating the major affairs of airport ports, coordinating the planning, construction, management and service of ports in airport areas, and coordinating the relationship between resident units and airport management agencies;

(five) to coordinate the relationship between the airport and the logistics park, bonded area and port construction management;

(six) to consider the airport government investment plan and the annual use plan of the local retained part of the airport fee put forward by the relevant departments;

(seven) to consider the scope, charging standards and awarding methods of airport franchise projects;

(eight) to consider other important matters concerning the development of civil aviation by local governments. Article 8 The director of the Municipal Airport Committee is the mayor or the deputy mayor in charge, and its members are composed of the municipal government's development and reform, planning, land, finance, construction, public security, transportation, environmental protection, industry and commerce, ports, state-owned assets and other departments, Baoan District government, customs, border inspection, national inspection, maritime affairs, civil aviation supervision office and other central units stationed in Shenzhen, base airlines, airport management agencies and other units, and the management committee has no more than 25 members. The Municipal Airport Committee may set up an advisory committee according to the management needs, and may invite domestic and foreign civil aviation experts and citizen representatives to participate.

The specific number of members of the Municipal Airport Committee and the specific candidates for members shall be determined by the municipal government.

The meeting of the Municipal Airport Committee shall be held at least once every quarter, and shall be convened by the director or the deputy director entrusted by the director. Specific rules of procedure shall be drawn up by the Airport Committee and submitted to the municipal government for approval. Article 9 The Municipal Airport Office shall be responsible for the daily affairs of the Airport Committee, and organize, coordinate and supervise the implementation of the decision-making matters of the Airport Committee. Specifically undertake the following responsibilities:

(1) To implement the resolutions and decisions of the Airport Committee, timely inspect and summarize the airport construction, management and business development, and report to the Airport Committee regularly;

(two) to implement the laws, regulations and rules of airport management; According to the reality of airport management and the requirements of the Airport Committee, draft local laws, regulations and normative documents related to airport management;

(three) to participate in the preparation and revision of the airport master plan, and coordinate the relevant departments to promote the airport capital construction projects;

(4) To study the implementation of the principles and policies of the civil aviation transportation industry, collect the development information of the civil aviation transportation industry at home and abroad, organize investigation and study on major airport issues, and put forward opinions and suggestions on improving airport management, so as to provide reference for the decision-making of the municipal government and the airport committee; Contact the superior civil aviation authorities and coordinate the relationship between the superior civil aviation authorities and the airport;

(five) to study the development direction of airport business, guide the development of civil aviation business in this Municipality, and promote exchanges and cooperation between airports and domestic and foreign airports and airlines;

(six) to assist the relevant competent departments to guide and coordinate the relevant work of the relevant units and inspection units in the airport area;

(seven) to undertake other tasks assigned by the municipal government and the airport committee.
