Ownership of outdoor unit of air conditioner in property law

The location of the outdoor unit of the air conditioner does not belong to the owner. Air-conditioned seats belong to neither the owner nor the property, and belong to public areas. It does not belong to the owner, but the owner has the right to use it. However, when the owner uses it, it can only be used to place outdoor air conditioners, and it cannot be smashed and turned into a private space. Air-conditioned seats cannot be expanded into balcony area, because air-conditioned seats are not personal territory.

The owner owns the exclusive part of the building such as the business building, and has the right to manage the * * other than the exclusive part. The owner has the right to possess, use, benefit and dispose of the exclusive part of the building. The owner's exercise of rights shall not endanger the safety of the building or damage the legitimate rights and interests of other owners. Owners shall enjoy rights and undertake obligations for the part other than the exclusive part of the building, and shall not fail to perform obligations on the grounds of giving up rights. In the case of divided ownership of buildings, the right to use construction land is shared by the owners, and the exclusive right in divided ownership of buildings is dominant. As long as the exclusive right is registered, the divided ownership will be established, and the * * * right and membership right will occur accordingly, without separate registration.

Article 28 1

The maintenance fund of the building and its ancillary facilities belongs to the owner. With the consent of the owner, it can be used for local maintenance, renewal and transformation of elevators, roofs, external walls and barrier-free facilities. The collection and use of maintenance funds for buildings and their ancillary facilities shall be announced regularly.

In case of emergency, if the building and its ancillary facilities need to be repaired, the owners' assembly or the owners' committee may apply for the maintenance funds of the building and its ancillary facilities according to law.
