When does the owner pay the property fee when the house leaks?

Legal analysis: there are three reasons for not repossessing a building:

1. During the developer's on-site inspection, the owner refused to take over the building on the grounds that the quality of the house affected the occupancy. In this case, you don't have to pay the management fee before the developer finishes the maintenance or you fail the acceptance, and the management fee generated during this period will be handed over to the property by the developer.

Second, the developer did not inform the delivery time, resulting in the owner not accepting the house. In this case, the owner may not pay the management fee.

3. The owner has received the delivery and occupancy information (you have been informed of the delivery and occupancy date) or should have known the delivery and occupancy information (the developer has issued relevant notices in the local media), but the owner has not gone through the formalities of receiving the house. In this case, the owner should pay the property fee from the delivery date stipulated by the developer.

Legal basis: Article 6 10 of the Civil Code of People's Republic of China (PRC). If the subject matter does not meet the quality requirements, so that the purpose of the contract cannot be achieved, the buyer may refuse to accept the subject matter or terminate the contract. If the buyer refuses to accept the subject matter or terminates the contract, the risk of damage or loss of the subject matter shall be borne by the seller.
