Can I not pay the property fee if I don't accept the house?

Do not accept the house or pay the property fee as the case may be, as follows:

1. According to the relevant national regulations, as long as the developer does not ask the owner to take back the house in any way, no matter whether it is a hardcover house or a rough house, there is no need to pay the property fee;

2. If the house has met the delivery conditions, and the key has not been taken due to personal factors, and it meets the delivery standard, the property fee will be paid.

The collection method of property fees for long-term non-residence of houses is as follows:

1. 1 year can pay 50% of the property fee, and after 1 year, you must pay the property fee in full regardless of whether you live there;

2. Vacant houses that do not intend to be renovated directly can pay 70% of the property fee;

3. If the house is well decorated and you don't move in, you need to pay 100% of the property fee, otherwise you will be liable for breach of contract;

4. Because the developer fails to deliver the house on time or the house has been delivered, but the developer has not sold it, the property fee shall be borne by the owner.

The charging standards for property fees are as follows:

1. In the new provisions of Property Law 2023, the standard of property fee is: the first-class fee is 65438+ 0.00 yuan per square meter, including taxes;

2. The secondary charging standard is 0.75 yuan per square meter per month, including taxes and fees;

3. The third-level charging standard is 0.50 yuan per square meter per month, including taxes and fees;

4. The four-level charge standard is 0.35 yuan per square meter per month, which also includes taxes. The owner shall pay the property fee to the property service provider as agreed. If the property service provider has provided services in accordance with the agreement and relevant regulations, the owner shall not refuse to pay the property fee on the grounds that he has not accepted or does not need to accept the relevant property services.

To sum up, even if the house is idle and uninhabited, as long as the developer has delivered the house, the owner needs to pay the property fee according to the regulations.

Article 41 of the Regulations on Property Management

The owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.

Property that has been completed but has not been sold or handed over to the property buyer shall be paid by the construction unit.

The price departments of the people's governments at or above the county level shall, jointly with the real estate administrative departments at the same level, strengthen the supervision of property service charges.
