Regulations of Jiaxing Municipality on the Administration of Residential Property

Chapter I General Provisions Article 1 In order to regulate residential property management activities and safeguard the legitimate rights and interests of owners and property service providers, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "residential property management" as mentioned in these Regulations refers to the management and maintenance of buildings and their ancillary facilities, environmental sanitation and related order in accordance with the provisions of the property service contract. Article 3 Property management activities shall be guided by Party building, adhere to professional services, and implement owner autonomy. Article 4 The Municipal People's Government shall sort out the administrative penalties and law enforcement subjects involved in property management, make a list and make it public.

The relevant law enforcement units shall promptly investigate and deal with the illegal acts reported by property service providers and the complaints of relevant owners. Fifth city and county (city, district) construction department is responsible for the supervision and management of property management activities within their respective jurisdictions.

County (city, district) construction departments should strengthen the business training and guidance for neighborhood (village) committees, owners' committees and property service providers. Article 6 The municipal construction department shall establish a digital platform for property management, promote the construction of smart property and improve the level of property management.

Encourage the use of electronic voting to vote on matters decided by the owners. Seventh property service industry associations should strengthen industry self-discipline, carry out business training, assist in handling property management disputes, and promote the healthy and orderly development of the industry. Chapter II Owners and Owners' Organizations Article 8 The construction unit shall, within 30 days from the date when the property management area meets the conditions for the establishment of the owners' meeting, submit a written report on the establishment of the owners' meeting to the neighborhood office (town people's government) or neighborhood committee where the property is located.

If the construction unit fails to submit it in time, the owner may submit a written request for the establishment of the owners' meeting to the sub-district office (town people's government) or the neighborhood (village) people's Committee. Ninth street offices (town people's government) and neighborhood committees shall, within 60 days from the date of receiving the written report of the construction unit or the written request of the owners, guide the formation of the preparatory group for the owners' meeting. Article 10 The preparatory group consists of representatives of the owners, neighborhood offices (town people's governments), neighborhood (village) committees and personnel of the construction unit, which shall be singular. The owners' representatives shall be recommended by the neighborhood (village) committees, not less than half of the total number of the preparatory group. If the construction unit fails to send personnel to participate in the preparatory group, it will not affect the establishment of the preparatory group.

The head of the preparatory group shall be the sub-district office (town people's government) or a member of the neighborhood (village) people's committee. The preparatory group shall, within three days from the date of its establishment, announce the list of members in a prominent position in the property management area. Article 11 Property service providers shall, within seven days from the date of the establishment of the preparatory group, provide the preparatory group with the list of owners, the list of houses and construction area, the general plan of construction project design, the list of facilities, the list of houses for property services and other materials needed for the preparation of the first owners' meeting. Twelfth the preparatory group shall do the following work:

(a) to confirm the identity of the owners, the number of owners and the area of the exclusive part owned by them;

(two) to determine the time, place, form and content of the first owners' meeting;

(three) to draft the rules of procedure and management regulations of the owners' congress;

(four) to determine the voting rules for the first meeting of the owners' congress;

(five) to formulate the methods for the selection of candidates for members of the owners' committee and determine the list of candidates;

(six) the drafting of the owners' committee election method. Article 13 The preparatory group shall organize the first meeting of the owners' congress within 90 days from its establishment, adopt the rules of procedure and management regulations of the owners' congress, and elect the owners' committee. Fourteenth the preparatory group shall, within ten days from the date of filing by the owners' committee according to law, hand over all the materials and the balance of preparatory funds to the owners' committee, and the preparatory group shall be dissolved by itself after the handover.

If the first meeting of the owners' congress is not organized within the prescribed time limit, the preparatory group may apply to the subdistrict office (town people's government) or the neighborhood (village) people's committee for an extension of 60 days; If the first owners' meeting is not held after the extension or expiration of the extension period, the sub-district office (town people's government) and neighborhood (village) committees shall announce the dissolution of the preparatory group, take over the materials and funds, and guide the formation of a new preparatory group within 60 days. Fifteenth owners' committee fails to organize regular meetings of the owners' congress in accordance with the rules of procedure of the owners' congress, or should convene an interim meeting without organizing it, the neighborhood (village) committee shall report to the subdistrict office (town people's government). Ordering the subdistrict office (town people's government) to hold it within a time limit; If it is not held within the time limit, the street office (town people's government) shall guide the owners to hold it. Sixteenth for the property that has not been delivered, the owners' committee shall inform the construction unit in writing of the matters decided by the owners' congress. When the construction unit delivers the property, it shall inform the owners in writing of the matters decided by the owners' congress. Article 17 The owners' congress may decide to establish the owners' congress. The owners' congress shall perform the duties authorized by the owners' congress.

Representatives of the owners are elected by the owners in units of buildings, units or floors, with a total number of not less than 50 people.

The rules of procedure of the owners' congress shall be formulated by the owners' congress.
