Long-term housing property fee collection standard

Legal analysis: the collection standard of long-term vacant property fees is not uniform in law. If the house is not occupied for a long time, the property fee shall be collected in the following ways: for the completed property but not yet sold or delivered, the property service fee shall be borne by the construction unit. For the delivered property, the property service fee shall be borne by the owner, unless otherwise agreed between the construction unit and the owner. If the property is vacant for a long time after delivery, the charging standard of the property service fee shall be agreed in the property service contract. At present, the composition of property management fees mainly includes garbage cleaning fees, cleaning fees, security fees, greening fees, manure treatment fees, maintenance fees for public facilities in residential areas, public lighting electricity fees, elevator operation fees and so on. As can be seen from the composition of the above-mentioned property management fees, most of the property management fees belong to the management of all owners and the maintenance of facilities and equipment, mostly for all owners of the whole community, and there is no specific service for one owner. In this sense, the lack of use of the owner's house does not affect the development of services provided by the property management company to the whole community, such as security, cleaning and greening of public land, and maintenance of public equipment. Therefore, the fundamental object of property services is the owner's house, not the owner.

Legal basis: Article 937 of the Civil Law of People's Republic of China (PRC) is a property service contract in which the property service provider provides the owner with property services such as the maintenance of buildings and ancillary facilities, the management and maintenance of environmental sanitation and related order, and the owner pays the property fee. Property service providers include property service enterprises and other managers.
