Quzhou City Greening Ordinance

Article 1 In order to build a modern garden city and a national ecological garden city, improve people's physical and mental health, and promote the sustainable development of urban greening, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on Urban Greening of the State Council and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection and management of urban greening within the urban planning area of this Municipality.

The planning, construction, protection and management of urban greening in the town planning area where the county people's government is located and other town planning areas determined by the county people's government shall be implemented in accordance with these regulations.

Where laws and regulations provide otherwise for scenic spots, forest parks and woodlands, such provisions shall prevail. Article 3 Urban greening shall adhere to the principles of government leading, public participation, local conditions, scientific planning, and equal emphasis on protection and management. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate the planning, construction, protection and management of urban greening into the national economic and social development plans and annual plans, ensure the funds needed for the construction, protection and management of urban greening, and include the funds in the fiscal budget at the corresponding level.

Encourage the establishment of public welfare funds. Advocate and mobilize citizens, legal persons or other organizations to participate in the construction, protection and management of urban greening by means of investment, donation, funding and adoption.

Encourage the development of high-quality demonstration activities such as comprehensive parks and garden-style residential quarters (units).

Units and individuals that have made outstanding contributions in urban greening work shall be commended and rewarded by the people's governments of cities and counties (cities, districts) or the administrative departments of urban greening in accordance with the relevant provisions of the state and the province. Fifth city and county (city, district) housing and urban and rural construction administrative departments responsible for the supervision and management of urban greening within the planned area of this Municipality.

Planning, comprehensive administrative law enforcement, forestry, transportation, water conservancy, land and resources, civil affairs, finance and other administrative departments shall, in accordance with relevant laws, regulations and rules, perform their duties of urban greening within their respective functions and duties.

Quzhou Green Industry Cluster Management Committee and Chengxi District Management Committee are responsible for the urban greening related work within their respective jurisdictions in accordance with the prescribed responsibilities.

The township (town) people's government and sub-district offices within the urban planning area shall be responsible for the relevant work of urban greening within their respective jurisdictions in accordance with the prescribed duties. Sixth city greening protection and management in accordance with the following provisions to determine the responsible person:

(a) the greening of the park green space, protective green space and road attached green space invested by the government shall be the responsibility of the urban greening administrative department or its entrusted unit; Involving forestry, transportation, water conservancy, land resources and other departments, according to their respective responsibilities;

(two) the greening of the green space attached to the unit and the protective green space within its jurisdiction shall be the responsibility of the unit;

(three) the greening of production green space is the responsibility of its business unit;

(four) the implementation of property management in residential areas, the green space is responsible for the entrusted property service enterprises; If the owners manage themselves, the owners' committee shall be responsible for it on behalf of all the owners; Without the implementation of property management and the establishment of the owners' committee, the township (town) people's government and the street office shall be responsible for it;

(five) the green space greening within the scope of the construction project shall be undertaken by the construction unit before the handover;

(six) other urban green space greening, by its owners and managers in accordance with the agreement; If there is no clear agreement, the owner shall be responsible.

The relevant departments, units, property service enterprises and other responsible persons for the protection and management of urban greening as stipulated in the preceding paragraph shall formulate urban green space management systems and strengthen the inspection of green space within their management scope. Found that the occupation, destruction of green space and other illegal acts, should be promptly discouraged; If dissuasion is ineffective, it shall promptly inform the comprehensive administrative law enforcement department of the relevant situation. Seventh urban greening maintenance management should abide by the technical specifications for urban green space maintenance formulated by the administrative department of urban greening, and establish and improve the urban greening maintenance management files.

Promote the market-oriented operation of urban greening and conservation and the reduction, harmlessness and resource utilization of branches and flowers Eighth planning administrative departments in conjunction with the administrative departments of urban greening and other organizations to prepare or modify the urban green space system planning, submitted to the people's government at the same level for approval before implementation. Regulatory detailed planning shall implement the relevant contents of urban green space system planning.

When compiling the overall urban planning, county (city) overall planning, urban green space system planning and regulatory detailed planning, the urban green space control line (hereinafter referred to as the green line) shall be clearly defined, and after being approved according to law, it shall be announced to the public and accepted by the public.

The green line shall not be adjusted at will. If the green line needs to be adjusted due to urban construction, it shall be handled in accordance with the original examination and approval procedures. To reduce the planning green space, the planning administrative department shall, jointly with the urban greening administrative department, implement the new planning green space. Ninth planning administrative departments in the review of greening projects, parks, underground space development projects and construction projects supporting greening projects, construction project design, should seek the views of the administrative department of urban greening.

Signs and signs shall be set up in the park green space, and the construction unit shall solicit the opinions of the administrative department of urban greening, which shall give timely guidance.
