Measures of Shanghai Municipality on the Administration of Recycling of Renewable Resources

Chapter I General Provisions Article 1 (Purpose and Basis)

In order to strengthen the recycling management of renewable resources, save resources, protect the environment and maintain public order, these measures are formulated in accordance with the provisions of the People's Republic of China (PRC) Cleaner Production Promotion Law, the People's Republic of China (PRC) Law on the Prevention and Control of Environmental Pollution by Solid Wastes and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 (Scope of Application)

The term "renewable resources" as mentioned in these Measures refers to all kinds of wastes that have completely or partially lost their original use value and can regain their use value after recovery, storage and processing.

Where there are other provisions in laws, regulations and rules on the recycling of scrapped automobiles, used electrical and electronic products, hazardous wastes and medical wastes, those provisions shall prevail. Article 3 (Responsibilities of Management Department)

The Municipal Department of Commerce is the competent department in charge of recycling renewable resources in this Municipality. The district and county commercial departments are responsible for the management of renewable resources recovery within their respective administrative areas.

City and county development and reform, economic informatization, land planning, urban greening, transportation construction, housing management, state-owned assets, finance, public security, industry and commerce, environmental protection, education, statistics and other departments shall, according to their respective responsibilities, do a good job in the management of renewable resources recovery. Article 4 (Responsibilities of District and County Governments)

District and county governments should strengthen their leadership in the recycling of renewable resources within their respective administrative areas, establish and improve the responsibility system and assessment system for promoting the recycling of renewable resources, and urge and coordinate relevant departments such as district and county commerce to perform their duties of promoting the recycling of renewable resources and strengthening the management of recycling of renewable resources.

Sub-district offices and township governments shall cooperate with relevant departments to do a good job in the management of renewable resources recovery. Article 5 (Trade Associations)

Shanghai Renewable Resources Recycling Industry Association (hereinafter referred to as "Shanghai Renewable Resources Association") shall strengthen industry self-discipline, supervise members' business activities, cooperate with commercial departments to study and formulate industry development plans, industrial policies and business norms, and carry out consulting services, business training and industry information release according to law.

The Municipal Renewable Resources Association shall accept the business guidance of the commercial department and assist the relevant departments to implement the management of renewable resources recycling industry. Chapter II Construction of Recycling System Article 6 (Industry Development Planning and Recycling Guidance Catalogue)

The Municipal Department of Commerce shall, according to the national economic and social development plan, circular economy development plan and the development of renewable resources recycling industry, organize the preparation of the development plan of renewable resources recycling industry.

The municipal administrative department of commerce shall, jointly with the municipal development and reform, greening the city, environmental protection, construction, transportation, economic informatization and other departments, compile and publish the guidance catalogue for recycling of renewable resources, clarify the types of recycling of renewable resources, recycling norms, utilization guidelines and other matters, and update the guidance catalogue for recycling of renewable resources as needed. Article 7 (Network Layout Planning and Facilities Construction)

The municipal, district and county commercial departments shall, according to the principle of "overall planning and rational distribution" and the specific conditions of the economic development level, population density, environment and resources of the administrative region, organize the preparation of the layout plan of renewable resource recycling outlets, and incorporate them into the corresponding urban and rural planning after approval in accordance with the prescribed procedures.

The layout planning and related facilities construction activities of renewable resources recycling outlets can be linked with the planning and construction of city appearance and environmental sanitation facilities; Conditional areas should be compatible with each other.

The recycling outlets of renewable resources referred to in this paper include all kinds of places where renewable resources stay in the process of recycling, transit, distribution and processing. Article 8 (Demonstration Recovery Point)

The municipal, district and county commercial departments shall, according to the planning of renewable resource recycling outlets, support renewable resource recycling operators to set up uniformly marked demonstration recycling points in shopping malls, supermarkets, commercial buildings, residential quarters and other places, promote convenient trading methods, apply advanced recycling technologies, and implement policies and measures to encourage recycling.

The municipal, district and county commercial departments shall clarify the management requirements of demonstration recycling points, guide relevant commercial enterprises to cooperate with renewable resource recycling operators, and carry out activities such as bonus points and trade-in for new ones to promote green consumption and recycling of renewable resources.

Commercial enterprises, building owners and property service enterprises participating in the demonstration recovery point shall provide necessary assistance and cooperation for the daily operation of the demonstration recovery point. Article 9 (Industrial Park Recycling Platform)

This Municipality encourages industrial park management agencies to cooperate with relevant renewable resource recycling operators, set up an e-commerce platform, and provide inquiry, bidding, auction and other services for renewable resource recycling trading activities in industrial parks to ensure the orderly conduct of renewable resource trading activities.

The industrial parks mentioned in this article refer to industrial parks, high-tech industrial development zones, bonded zones and export processing zones established according to law and managed by agencies dispatched or designated by the municipal, district or county governments. Article 10 (Compulsory Recycling of Some Products and Packages)

Enterprises that produce products and packages listed in the national compulsory recycling catalogue shall recycle the scrapped products and packages.

Production enterprises may entrust sales enterprises, recycling operators of renewable resources or other organizations to recycle. The trustee shall be responsible for recycling in accordance with the provisions of relevant laws and regulations and the contract.
