Property fees do not include elevator fees and garbage fees.
According to the Regulations on Property Management and the Measures for the Administration of Property Service Fees, the property service fees mainly include the following aspects:
1, salary of managers, social insurance and welfare expenses drawn according to regulations, etc.
2, the daily operation and maintenance costs of * * * parts of the property and * * * facilities and equipment;
3, property management area cleaning costs;
4, the property management area greening maintenance costs;
5, property management regional order maintenance costs;
6. Office expenses;
7. Depreciation of fixed assets of property management enterprises;
8. Part of the property, facilities, equipment and public liability insurance fees;
9. Other expenses agreed by the owner.
According to the above regulations, the elevator fee and garbage fee are not included in the property service fee. So the property fee does not include elevator fee and garbage fee.
First, the composition of property fees
Property service expenses mainly include the salary of managers, social insurance and welfare expenses extracted according to regulations, daily operation and maintenance expenses of parts, facilities and equipment used in the property, cleaning and sanitation expenses of the property management area, greening and maintenance expenses of the property management area, order maintenance expenses of the property management area, office expenses, depreciation of fixed assets of property management enterprises, and expenses of parts, facilities and equipment used in the property management area and public liability insurance.
Second, the nature of the elevator fee and garbage fee
Elevator fees and garbage fees do not belong to the category of property service fees, but belong to the operation and maintenance costs of public facilities. These costs are usually borne by the owners or users, not by the property management company.
Third, the relationship between property fees, elevator fees and garbage fees
Although the property management company may provide services such as elevators and garbage disposal for owners or users, the costs of these services are not included in the property service fee. Owners or users need to pay elevator fees and garbage fees respectively.
To sum up, the property fee does not include elevator fee and garbage fee. These fees need to be paid separately by the owner or user.
Legal basis:
Article 34 of the Regulations on Property Management: Property service enterprises shall provide corresponding services in accordance with the provisions of the property service contract. The realty service enterprise fails to perform the realty service contract, causing personal and property safety damage to the owner, and shall bear corresponding legal responsibilities according to law. Therefore, the owner shall not refuse to pay the property fee at will.
