Regulations of Zhengzhou Municipality on the Administration of Parking Lot Construction

Chapter I General Provisions Article 1 In order to strengthen the construction and management of parking lots, reasonably guide parking demand, standardize parking order and promote smooth roads, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction and use of parking lots in urban areas of this Municipality.

The term "urban areas" as mentioned in these Regulations refers to the areas within the administrative area of this Municipality except counties (cities) and Shang Jie District. Article 3 The term "public parking lot" as mentioned in these Regulations refers to places that provide parking services to the public outside urban roads, including public parking lots built independently and public parking lots built by construction projects as public service facilities.

Special parking lot refers to the place that provides parking services for vehicles in the unit and residential area outside the city road, including special parking lot for construction projects and some parking spaces designated in the construction area.

Temporary parking lot refers to a place for short-term parking of motor vehicles outside urban roads, using the land to be built, the stock of construction land and some owners in the building division.

On-street parking spaces on urban roads refer to places set up on urban roads for temporary parking of motor vehicles. Article 4 The construction and management of parking lots shall follow the principles of government leading, overall planning, social co-governance, convenience and high efficiency. Article 5 The Municipal People's Government shall organize relevant departments to establish a joint conference system for parking lot construction and management, and coordinate and solve major problems in parking lot planning, construction and management.

The District People's Government shall be specifically responsible for the construction and management of parking lots within its administrative area.

Township people's governments and sub-district offices shall assist in parking management and guide community residents' committees, owners' committees and other relevant units to carry out parking autonomy. Article 6 The municipal administrative department in charge of urban management is responsible for the overall planning, coordination, supervision and guidance of parking lot management, and the district administrative department in charge of urban management is responsible for the specific management of parking lots within their respective administrative areas, such as inspection, inspection and business filing.

The municipal administrative department of natural resources and planning is responsible for the planning and management of parking lots.

The administrative department of urban and rural construction is responsible for the supervision and management of parking lot construction.

Development and reform, finance, traffic management of public security organs, big data management, transportation, housing security and real estate management, market supervision and management, civil air defense, emergency management and other relevant departments shall perform the relevant duties of parking lot construction and management in accordance with laws and regulations. Article 7 The municipal and district people's governments shall incorporate the funds needed for government investment to support social capital to build public parking lots into the fiscal budget at the same level.

The municipal and district people's governments shall broaden the investment channels for parking lot construction and guide diversified investment in the construction of intensive parking facilities such as ecological parking lots and parking buildings, underground parking lots and mechanical three-dimensional parking garages. Article 8 Support and promote intelligent parking services. Establish a unified parking information management and service system in the city, improve the informatization level of parking management, and promote the construction of a smart transportation city. Chapter II Planning and Construction of Parking Lot Article 9 The municipal administrative department of natural resources and planning shall, jointly with the departments of development and reform, urban and rural construction, urban management, traffic management of public security organs, transportation, civil air defense, etc., formulate a special parking lot plan, which shall be promulgated and implemented after being approved by the Municipal People's Government.

The planning of special parking lots should comprehensively consider factors such as population size and density, land development status, vehicle ownership, road traffic carrying capacity, contradiction between parking supply and demand, public transportation service level, etc., and scientifically determine the regional layout, setting scale, medium and long-term construction planning and construction order of public parking lots, special parking lots and urban on-road parking berths.

Parking space allocation standards for construction projects shall be determined by the municipal administrative department of natural resources and planning in accordance with the provisions of the preceding paragraph, and shall be regularly evaluated and adjusted, and promulgated to the public for implementation.

No unit or individual may change the approved parking lot special planning without authorization. If it is really necessary to change, it shall be reported to the original examination and approval authority for approval, but the number of parking spaces shall not be reduced. Article 10 The municipal and district administrative departments of urban and rural construction shall, according to the special planning of parking lots, work out the annual construction plan of public parking lots in conjunction with the departments of development and reform, finance, natural resources and planning, urban management, traffic management of public security organs, civil air defense, etc., and report it to the people's government at the same level for approval before implementation.

The annual construction plan of public parking lots shall include the construction subject, responsible units, construction sequence, investment scale, sources of funds and the number of parking spaces. Eleventh city natural resources and planning administrative departments in the preparation of land and space planning, public parking lot construction land should be planned.

Public parking lot construction land shall be allocated, transferred or leased according to law. A certain amount of land reserved by the government should be used for the construction of public parking lots.

On the premise of conforming to the national spatial planning, public parking lots can be built on collective construction land according to law. Twelfth hospitals, schools, commercial centers, government service centers, public cultural service places and other construction projects should be in accordance with the relevant design norms and construction standards to build parking lots, and at the same time with the main project planning, design, construction, acceptance and delivery.

The administrative department of natural resources and planning shall, in accordance with the relevant provisions, plan and verify the completed parking lot.

If the design scheme and construction drawing of the construction project parking lot do not meet the construction standards, the administrative department of natural resources and planning shall not issue the construction project planning permit, and the administrative department of urban and rural construction shall not issue the building construction permits.
