What are the circumstances of producer's quality responsibility exemption?
Legal analysis: the producer's quality responsibility is exempted from compensation under the following circumstances: if the producer can prove one of the following circumstances, it will not be liable for compensation: (1) the product has not been put into circulation; (2) When the product is put into circulation, the defect causing damage does not exist; (3) When the product is put into circulation, the level of science and technology cannot find the existence of defects.
Legal basis: Article 41 of the Product Quality Law of People's Republic of China (PRC), if a product is defective and causes personal injury or damage to property other than the defective product (hereinafter referred to as other people's property), the producer shall be liable for compensation.
The producer shall not be liable for compensation if he can prove any of the following circumstances:
(1) Failing to put the product into circulation;
(2) When the product is put into circulation, the defect causing damage does not exist;
(3) When the product is put into circulation, the level of science and technology cannot find the existence of defects.
