Regulations of Guangdong Province on the Treatment of Urban and Rural Domestic Waste

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Regulations on the Administration of City Appearance and Environmental Sanitation and other relevant laws and administrative regulations, and in light of the actual situation of this province. Article 2 These Regulations shall apply to activities such as cleaning, classification, collection, transportation and disposal of urban and rural domestic garbage within the administrative area of this province.

The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste identified as domestic waste by laws and administrative regulations. Article 3 The treatment of urban and rural domestic garbage shall follow the principles of overall planning of urban and rural areas, territorial management, participation of the whole people and classified treatment, and implement reduction, resource utilization and harmless control and management. Article 4 People's governments at all levels shall incorporate the treatment of urban and rural domestic garbage into the national economic and social development plan, set the targets for the treatment of urban and rural domestic garbage, and implement the safeguard measures for the cleaning, classification, collection, transportation and disposal of urban and rural domestic garbage.

Township people's governments and sub-district offices shall be responsible for the treatment of urban and rural domestic garbage within their respective jurisdictions, and guide villagers' committees and residents' committees to organize the cleaning, classification, collection, transshipment and disposal of domestic garbage. Fifth provincial people's government housing and urban construction departments to guide the province's urban and rural domestic waste treatment.

The competent department of environmental health of the people's government of the city and county (District) shall be responsible for the treatment of urban and rural domestic garbage within their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, cooperate in the treatment of urban and rural domestic waste. Article 6 Units and individuals shall try their best to reduce the generation of domestic garbage, put it into different categories according to regulations, and pay the garbage disposal fee. Article 7 People's governments at all levels shall strengthen the publicity and education on domestic waste disposal, enhance the public's awareness of domestic waste reduction and classification, advocate a green and healthy lifestyle, and encourage the public to participate in the supervision activities on domestic waste disposal.

The competent education department should take the knowledge of source reduction, classification, recovery and harmless treatment of domestic garbage as the content of school education and social practice.

The media should publicize the classified treatment of domestic garbage for public welfare. Chapter II Classified Delivery Article 8 Urban and rural domestic garbage shall be classified and delivered to designated collection points or containers.

Urban and rural domestic waste is divided into the following four categories:

(1) Recyclable articles refer to articles suitable for recycling and reuse, such as paper products, plastic products, glass products, textiles and metals.

(2) Organic perishable garbage refers to catering garbage, household kitchen waste and discarded vegetables, fruits, flowers and trees.

(3) Hazardous wastes refer to substances that cause direct or potential harm to human health and natural environment, such as discarded rechargeable batteries, button cell, lamps, medical supplies, pesticides, paints, daily chemicals, mercury products, discarded pesticides, fertilizer residues and packaging materials.

(4) Other garbage refers to domestic garbage other than the first three items, such as inert garbage, non-degradable disposable articles, ordinary mercury-free batteries, cigarette butts, paper towels, household decoration wastes, discarded furniture, etc.

The people's governments at or above the prefecture level may, according to the local actual situation, formulate specific measures for the classification of urban and rural domestic waste, and guide urban and rural residents to put garbage in a classified way. Ninth classified management of domestic waste management responsibility system:

(a) residential areas, streets and other property management areas, the property management unit is responsible for; If the unit manages itself, it shall be responsible for the self-management unit; If there is no property management or the unit manages itself, the residents' committee shall be responsible for it;

(2) Villagers' committees are responsible for rural areas;

(three) the office space of organs, military units, enterprises and institutions, social organizations and other organizations shall be the responsibility of this unit;

(four) the construction site of the construction project, the construction unit is responsible for;

(five) bazaars, shopping malls, exhibitions, catering services, shops and other places of business, by the management unit; If there is no business management unit, the business unit shall be responsible for it;

(six) roads, highways, railways, bridges, tunnels, crosswalks (bridges), airports, ports, docks, railway stations, long-distance passenger stations, bus stations, rail transit stations, parks, tourist attractions, rivers and lakes and other public places and public buildings, by the owners or other actual managers;

(seven) unable to determine the responsible person of domestic waste classification management, the local township people's government, street offices to implement the responsible person. Article 10 Responsibilities of the person in charge of domestic waste classification management:

(a) to establish a daily classification management system for domestic waste, record the types and whereabouts of domestic waste, and accept the supervision and inspection of the competent department of environmental health;

(two) to carry out the knowledge propaganda of domestic waste classification, and to guide and supervise the units and individuals to carry out the work of domestic waste classification;

(3) According to the output and classification of domestic waste, set up domestic waste classified collection points and collection containers according to standards and classification marks, and keep the domestic waste classified collection containers in normal use;

(four) the time and place to remove domestic garbage;

(5) Stop mixing and sorting domestic garbage;

(six) to supervise and inspect the classification of garbage and hand over the garbage to the relevant units for treatment.
