At present, the state has not formulated relevant policies to cancel the property fee, but this statement is wrong in the rumors that the state will cancel the property fee. After the owner signs a property service contract with the residential property, the property will provide the owner with management services such as maintenance, conservation and environmental sanitation of buildings, public facilities and sites according to the contract. Now that the owner has enjoyed this service, of course, he must pay the corresponding property fees on time, and the property fees charged in accordance with relevant regulations must be clearly marked. If it is not cancelled, the new provisions on property fees in 2023 are as follows:

1. In the new provisions of Property Law 2023, the standard of property fee is: the first-class fee is 65438+ 0.00 yuan per square meter, including taxes;

2. The secondary charging standard is 0.75 yuan per square meter per month, including taxes and fees;

3. The third-level charging standard is 0.50 yuan per square meter per month, including taxes and fees;

4. The four-level charge standard is 0.35 yuan per square meter per month, which also includes taxes. The owner shall pay the property fee to the property service provider as agreed. If the property service provider has provided services in accordance with the agreement and relevant regulations, the owner shall not refuse to pay the property fee on the grounds that he has not accepted or does not need to accept the relevant property services.

It is the owner's obligation to pay the property fee, but sometimes the property fails to properly manage the property and has the right to refuse to pay the property fee under the circumstances stipulated by law. According to the property management regulations, there are eight situations in which owners can refuse to pay property fees:

(1) The property fee shall be collected from the date when the owner receives the notice of repossession, instead of the delivery date agreed in the house purchase contract. If the developer fails to notify the owner to repossess the building, so the repossession is delayed, the owner may refuse to pay the property fee during this period;

(2) If the property management company has not signed a contract with the owner, the owner may refuse to pay;

(3) If the energy cost generated by power equipment such as heating and central air conditioning required by the property management company is not within the scope of payment by the owner, it may refuse to pay;

(4) If the quality of property service is too poor, you can stop work and refuse to pay, but you must have strong evidence to find a substantive solution;

(5) When the property provides services not agreed in the contract or without the consent of the owner, the owner has the right to refuse to pay;

(6) If the property management company raises the charging standard of property services without authorization, the owner may refuse to pay the part raised without authorization;

(7) If the house is not delivered due to the quality problem of the house, the property fee shall be paid by the developer;

(8) If the property company does not have the original approval document of the price management department, the owner may refuse to pay;

Therefore, the owner has the right to refuse to pay the property management fee in case of the above situation, so as to safeguard his legitimate rights and interests.

If the owner is in arrears with the property fee, the property service provider may call for payment or bring a lawsuit, but shall not stop calling for payment of power supply, water supply, heat supply and gas supply. This is because electricity, water, heat and gas are the necessities of the owners' basic life. Even if it is in arrears, it should not harm the interests of the owners in this way. If the owner fails to pay the property fee within the time limit in violation of the agreement, the property service provider may urge him to pay it within a reasonable period of time; If the payment is not made within a reasonable time limit, the property service provider may bring a lawsuit or apply for arbitration. In violation of the property service contract, the owners fail to pay the property service fee within the time limit, and the owners' committee shall urge them to pay it within a time limit; If it fails to pay within the time limit, the realty service enterprise may bring a lawsuit to the people's court.

Legal basis:

Article 11 of the Regulations of People's Republic of China (PRC) Municipality on Property Management shall be decided by the owner:

(a) to formulate and amend the rules of procedure of the owners' congress;
