The main sewer in my bathroom leaks. Is the property responsible?

The property is responsible for the leakage of the main sewer pipe in the bathroom. Because the main sewer is for public use, the property is responsible for the maintenance of public facilities, and the resulting maintenance costs are borne by the maintenance fund.

According to Article 942 of the Civil Law of People's Republic of China (PRC), the property service provider shall, in accordance with the agreement and the nature of the use of the property, properly repair, maintain, clean, green and manage some owners in the property service area, maintain the basic order of the property service area, and take reasonable measures to protect the personal and property safety of the owners.

Property service providers shall take timely and reasonable measures to stop acts that violate laws and regulations such as public security, environmental protection and fire protection in the property service area, report to the relevant administrative departments and assist in handling them.

Article 4 of the Measures for the Administration of the Use of Public Maintenance Funds is specially used for the maintenance of residential facilities and equipment after the warranty period expires. The term ×××× residential facilities and equipment as mentioned in these Measures refers to the housing-related parts and facilities and equipment owned and used by all or part of the property owners in the residential building or property management area.
