According to the court prosecution stipulated in the property service contract, it is generally to the court where the owner defaults on the property fee.

Article 67 of the Regulations on Property Management stipulates that if the owner fails to pay the property service fee within the time limit in violation of the property service contract, the owners' committee shall urge him to pay it within a time limit. If it fails to pay within the time limit, the realty service enterprise may bring a lawsuit to the people's court.

Article 6 of the Supreme People's Court's Judicial Interpretation on Several Issues Concerning the Trial of Property Management Disputes stipulates that if the owner refuses to pay the property fee within a reasonable period after being urged in writing without justifiable reasons, and the property enterprise requests the owner to pay the property fee, the people's court shall support it. The realty service enterprise has provided services in accordance with the stipulations of the realty service contract and the relevant provisions, and the people's court shall not support the owners only because they have not enjoyed or need to accept the realty service.
