Regulations of Shanghai Municipality on the Administration of Urban Appearance and Environmental Sanitation (revised in 2009)

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation, maintain the cleanliness and beauty of the city, safeguard the health of citizens and promote the construction of socialist spiritual civilization, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the central cities, new towns, central towns, independent industrial zones, economic development zones and other urbanized areas of this Municipality. Article 3 The city appearance and environmental sanitation work of this Municipality shall follow the principles of unified leadership, hierarchical management, public participation and social supervision. Fourth city appearance and environmental sanitation management department is in charge of city appearance and environmental sanitation work, and is responsible for the organization and implementation of these regulations.

District (county) city appearance and environmental sanitation management department under the leadership of the people's government at the same level, responsible for the city appearance and environmental sanitation management within their respective jurisdictions.

Neighborhood offices and town people's governments are responsible for the management of city appearance and environmental sanitation within their respective jurisdictions, coordinate, supervise and inspect the city appearance and environmental sanitation within their respective regions, and urge units and individuals to fulfill their obligations of maintaining city appearance and environmental sanitation.

City and district (county) urban management administrative law enforcement departments (hereinafter referred to as urban management law enforcement departments) shall impose administrative penalties on the illegal acts of city appearance and environmental sanitation stipulated in these regulations.

Other relevant administrative departments of this Municipality shall, in accordance with their respective duties, coordinate the implementation of these Regulations.

This Municipality advocates and encourages residents' committees to organize residents to formulate conventions on maintaining city appearance and environmental sanitation, mobilize residents to actively participate in city appearance and environmental sanitation management activities, and create a clean, beautiful and civilized environment. Article 5 The municipal and district (county) people's governments shall incorporate city appearance and environmental sanitation into the national economic and social development plan, improve city appearance and environmental sanitation facilities, provide city appearance and environmental sanitation services, and ensure the funds needed for city appearance and environmental sanitation construction. Sixth city appearance and environmental sanitation management department shall, according to the needs of the development of city appearance and environmental sanitation, organize the preparation of city appearance and environmental sanitation professional planning, and incorporate it into the overall urban planning after comprehensive balance by the city planning management department. Article 7 This Municipality encourages and supports scientific and technological research on city appearance and environmental sanitation, and promotes and applies advanced technologies to improve the level of city appearance and environmental sanitation. Article 8 All units and individuals have the right to enjoy good city appearance and environmental sanitation, and they also have the obligation to maintain the city appearance and environmental sanitation. Article 9 The municipal and district (county) administrative departments of city appearance and environmental sanitation and the administrative departments of culture, radio, film and television, press and publication, education and health, as well as the operating or managing units of public places such as airports, stations, docks and tourist attractions, should strengthen publicity and education of city appearance and environmental sanitation and enhance citizens' awareness of maintaining city appearance and environmental sanitation.

Radio, television, newspapers and outdoor advertisements in this Municipality shall have public welfare publicity contents in terms of city appearance and environmental sanitation. Chapter II System of Area of Responsibility for City Appearance and Environmental Sanitation Article 10 This Municipality implements the system of area of responsibility for city appearance and environmental sanitation. The relevant units and individuals shall, in accordance with the provisions of these regulations, do a good job in the city appearance and environmental sanitation work in the area of responsibility. Eleventh city appearance and environmental sanitation responsibility area refers to the buildings, structures or other facilities, places and areas owned, used or managed by relevant units and individuals within a certain range.

The specific scope of the city appearance and environmental sanitation responsibility area shall be determined by the city or district (county) city appearance and environmental sanitation management department according to the standards published by the city appearance and environmental sanitation management department. Twelfth city appearance and environmental sanitation responsibility area responsible person is determined in accordance with the following provisions:

(a) the residential area where property management is implemented shall be the responsibility of the property management enterprise, and the residential area where property management is not implemented shall be the responsibility of the residents' committee;

(2) Sluices in coastal waters and rivers shall be the responsibility of users or managers of shoreline and sluices;

(three) subways, light rails, tunnels, elevated roads, highways and railways, which are in the charge of the business management units;

(four) culture, sports, entertainment, sightseeing, parks, public green spaces, airports, stations, docks and other public places, by the management unit;

(five) fairs, exhibitions, shopping malls, restaurants and other places, by the management unit;

(six) the surrounding areas of organs, organizations, schools, troops, enterprises and institutions. , by the relevant units responsible for;

(seven) the construction site is the responsibility of the construction unit, and the land to be built is the responsibility of the owner;

(eight) the public areas of bonded areas, science parks, independent industrial zones and economic development zones are in charge of the management units.

In accordance with the provisions of the preceding paragraph, the responsible person shall be determined by the administrative department of city appearance and environmental sanitation of the district (county).

The responsibility of the urban-rural fringe or the administrative boundary is unclear, and the determination of the responsible person is controversial, which shall be determined by the municipal administrative department of city appearance and environmental sanitation. Thirteenth city appearance and environmental sanitation responsibility area responsibility requirements are:

(a) to keep the city clean and tidy, and shall not set up stalls, set up, post, scribble, depict, hang and pile up without authorization;

(two) keep the environment clean and tidy, no exposed garbage, feces, sewage, no stains, no muck, no breeding grounds for mosquitoes and flies;

(three) set up environmental sanitation facilities in accordance with the regulations, and keep them clean and in good condition.

The person in charge of city appearance and environmental sanitation has the right to stop the acts that violate the provisions of city appearance and environmental sanitation management in the responsible area, and has the right to request the city or district (county) city appearance and environmental sanitation management department and urban management law enforcement department to deal with them.

If the person responsible for city appearance and environmental sanitation fails to fulfill his obligations, the urban management law enforcement department shall order him to make corrections; Refuses to correct, given a warning, and may impose a fine of fifty yuan to five hundred yuan, or suggest that the higher authorities deal with the directly responsible person in charge.
