Interim Measures of Chengdu Municipality on the Administration of Motor Vehicle Parking Service Charges

Article 1 (Purpose Basis)

In order to strengthen the management of motor vehicle parking service charges, standardize the behavior of motor vehicle parking service charges, and protect the legitimate rights and interests of motor vehicle parking people and motor vehicle parking lot operators, these measures are formulated in accordance with the People's Republic of China (PRC) Price Law and other relevant laws and regulations, combined with the actual situation in Chengdu. Article 2 (Scope of Application)

All units, individuals and motor vehicle parking people who are engaged in motor vehicle parking services according to law within the administrative area of this Municipality shall abide by these measures. Article 3 (Competent Authority)

The competent price department of the municipal and district (city) county governments shall be responsible for the supervision and management of parking service charges of various motor vehicle parking lots within their respective administrative areas. Article 4 (Price Form)

Motor vehicle parking service charges in this Municipality shall be subject to market adjustment price, government guidance price and government pricing according to the parking lot category. Article 5 (Market-regulated Price)

The following motor vehicle parking service charges are subject to market adjustment:

(a) professional indoor parking lot (building);

(2) Shopping malls, restaurants, teahouses, entertainment places, hotels, office buildings, enterprises and institutions supporting indoor parking lots. Article 6 (Government Guidance Price)

Parking fees for supporting motor vehicles in residential areas (including residents' courtyards and dormitories, the same below) are subject to government-guided prices. The benchmark price and floating range of the government-guided price shall be formulated by the price department of the municipal government and announced to the public. The specific charging standard shall be agreed by the construction unit or the property management institution in the purchase contract or property management contract with the purchaser or parking space user within the floating range of the government-guided price.

Before the implementation of these measures, the residential areas subject to government pricing, with the consent of more than 2/3 households, can implement government-guided prices according to the provisions of these measures.

Government pricing shall be applied to residential areas that do not meet the requirements specified in the preceding two paragraphs. Article 7 (Government Pricing)

The following motor vehicle parking service charges are subject to government pricing:

(a) supporting shopping malls, restaurants, teahouses, places of entertainment, hotels, office buildings, open-air parking lots of enterprises and institutions;

(2) Supporting parking lots (including indoor and outdoor) in airports, railway stations, docks, scenic spots, hospitals, museums, libraries, stadiums (gymnasiums), academic education schools, funeral services and other places;

(3) Professional outdoor parking lot;

(4) Temporary parking lots;

(5) Parking lots with special parking modes such as mechanical parking. Article 8 (Mixed Parking Lot)

Residential buildings, shopping malls, entertainment places, office buildings (rooms), hotels and other parking lots such as commercial and residential buildings and comprehensive buildings should give priority to meeting the parking needs of residents according to the regulations of the planning department. Residents' vehicles are parked at government-guided prices or government pricing; Other vehicles are parked, indoor parking lots are subject to market adjustment prices, and open-air parking lots are subject to government pricing. Article 9 (Composition of Expenses)

Motor vehicle parking service fee consists of parking space occupation fee, parking facilities and equipment purchase and maintenance fee, wages, benefits and taxes of parking management service personnel, compensation for vehicle damage and loss caused by improper storage of parking lot, and utilities required for normal operation of parking lot, etc. Article 10 (Scoring)

Government-priced parking lots are divided into senior parking lots and ordinary parking lots. Specific grade standards and grade general charging standards shall be formulated by the price department of the municipal government and announced to the public. Article 11 (Pricing Principles)

Parking service charges for all kinds of motor vehicle parking lots in urban areas shall be subject to the principle of pricing by region and time. Price, urban management, public security, transportation, planning and other municipal government departments divide different areas and time periods according to traffic flow and management needs, and formulate different charging standards for motor vehicle parking services. Article 12 (Method of Charging)

Motor vehicle parking service in this city adopts two charging methods: temporary parking and monthly parking. Temporary parking is charged on time or time, and monthly parking is charged on a monthly basis.

Supporting parking lots in residential areas shall not refuse residents to park on a monthly basis. Article 13 (Temporary Parking of Vehicles)

Accident vehicles and vehicles temporarily parked by administrative law enforcement departments shall be charged according to the parking lot charging standard, and it is strictly forbidden to charge other fees for any reason. Article 14 (Free of charge)

In any of the following circumstances, no motor vehicle parking service fee shall be charged:

(1) Military vehicles and police cars performing official duties;

(2) Special vehicles for duty;

(3) Vehicles passing normally on municipal roads under the closed management of the community;

(four) the vehicle is parked in the temporary parking lot for less than 15 minutes;

(5) The vehicle enters the outdoor parking lot of the residential area for less than 15 minutes;

(six) taxis that temporarily get on and off passengers in various parking lots. Article 15 (Examination and Approval Procedures)

The government pricing and government guidance price of motor vehicle parking fees shall be subject to the examination and approval system.

Government-priced parking lot operators shall submit a written application to the competent price department of the local (city) county government by the parking lot filing opinions and schedules of the relevant administrative departments, and receive the approval of government-priced motor vehicle parking fees after approval, and collect the motor vehicle parking service fees according to the charging standards stipulated in the approval. Government-guided parking lot operators shall, on the basis of the parking lot filing opinions and schedules of relevant management departments, and the parking service charging standards agreed and signed with the owners (tenants), go to the competent price department of the district (city) county government where they are located to receive the approval letter of government-guided motor vehicle parking charges.

Airport, railway station and scenic spots (spots) and other supporting motor vehicle parking lots need to be charged higher than the general level, it shall submit a written application to the price department of the municipal government, which shall determine the charging standard according to the parking lot facilities and equipment conditions and service level, and go through the relevant charging procedures at the price department of the district (city) county government where the parking lot is located.
