Measures of Tianjin Municipality on the Administration of Tendering and Bidding for Property Management?

In order to standardize the bidding activities of property management in our city, protect the legitimate rights and interests of the parties involved in bidding and promote fair competition in the property management market, these measures are formulated in accordance with the relevant provisions of the Bidding Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council, the Regulations on Property Management of Tianjin and the Regulations on Bidding and Bidding of Tianjin, and combined with the actual situation of this Municipality. The following is the "Tianjin Property Management Bidding Management Measures" brought by Zhong Da Consulting.

Within the administrative area of this Municipality, these Measures shall apply to the tendering and bidding activities carried out by hiring property service enterprises to implement property management.

Property management bidding should follow the principles of openness, fairness, impartiality and good faith.

Before the development and construction unit sells the newly-built property, it shall select a property service enterprise with corresponding qualification grade for property management through bidding. In the same property management area, the construction area of residential property is less than 30,000 square meters, and the construction area of non-residential property is less than 1 10,000 square meters. With the approval of the district or county real estate management bureau where the property is located, the property service enterprise with corresponding qualification grade can be selected by agreement.

The government advocates and encourages the owners' congress and other owners to choose property service enterprises with corresponding qualification grades through bidding.

Tianjin Municipal Bureau of Land Resources and Housing Management is responsible for the supervision and management of the city's property management bidding activities.

The district and county real estate management bureaus shall be responsible for the guidance and supervision of property management bidding activities within their respective jurisdictions.

Tianjin Municipal Bureau of Land Resources and Housing Management has designated a special property management bidding service agency to provide services for the city's property management bidding activities.

No unit or individual may violate laws, regulations and rules, restrict or exclude qualified property service enterprises from bidding, and may not illegally interfere in property management bidding activities in any way.

The term "tenderee" as mentioned in these Measures refers to the development and construction units, owners' congresses and other owners who bid for property management according to law.

If the owners' congress decides to select a realty service enterprise through bidding, it shall authorize its owners' committee to perform the duties of the tenderer and organize bidding activities.

Property management bidding shall be organized and implemented by the tenderee according to law.

The tenderer shall not restrict or exclude potential bidders with unreasonable conditions, and shall not put forward excessive qualification requirements to potential bidders that are inconsistent with the actual requirements of property management projects.

Property management bidding is divided into public bidding and invitation bidding.

If the tenderer adopts the method of public bidding, it shall publish a tender announcement in the public media, and at the same time publish a free announcement on the property management tender website designated by the Municipal Bureau of Land Resources and Housing Management. The announcement period shall not be less than 3 working days.
