20 19 Detailed Rules for the Application of Residence Permit for Floating Population in Hangzhou (for Trial Implementation)
In order to strengthen the service management of floating population, promote basic public services to cover all permanent residents, protect the legitimate rights and interests of floating population, and promote coordinated economic and social development, these rules are formulated in accordance with the Provisional Regulations on Residence Permit, Regulations on Residence Registration of Floating Population in Zhejiang Province, Regulations on Service Management of Floating Population in Hangzhou and the spirit of relevant laws and regulations, combined with the actual situation of this Municipality.
First, the floating population in the urban area of this Municipality shall apply for residence registration and apply for the Zhejiang Residence Permit (hereinafter referred to as the Residence Permit).
The floating population as mentioned in these rules refers to the non-registered personnel living in the urban areas of this Municipality. The urban areas include Shangcheng District, Xiacheng District, Jianggan District, Gongshu District, Xihu District, Binjiang District, Xiaoshan District, Yuhang District, Fuyang District and Lin 'an District.
Two, the city and district government floating population service management committee is responsible for the organization, coordination, supervision and guidance of the administrative area of the floating population service management. The public security organ or the service management institution entrusted by the public security organ is responsible for the residence registration and residence permit management of the floating population; Development and reform, education, civil affairs, justice, finance, taxation, human resources and social security, housing construction, housing management, transportation, health and family planning, market supervision, urban management and other departments shall, in accordance with their respective functions and duties, closely cooperate with each other to issue or assist township governments (street offices) to issue relevant certificates according to law, so as to facilitate floating population to apply for residence registration and residence permit; Community residents' committees, villagers' committees, owners' committees, real estate brokerage agencies, property service enterprises and employers shall cooperate with relevant departments and township governments (street offices) to do a good job in residence registration and service management of floating population.
3. In addition to the circumstances stipulated in Article 12 of the Regulations on Residence Registration of Floating Population in Zhejiang Province, if the floating population intends to live in the urban area of this Municipality for more than 3 days, it shall, within 3 days from the date of arrival at the place of residence, declare residence registration to the local police station or the service management institution entrusted by the public security organ. When the floating population applies for residence registration, they must submit their valid identity documents or proof of identity; Where the residential registration information such as residential address and service place is changed, the change registration shall be handled in accordance with the regulations.
/kloc-minors under the age of 0/6 shall be registered by their guardians; The elderly, the disabled, etc. Persons with mobility difficulties may entrust their close relatives to declare residence registration on their behalf. If the principal or agent declares residence registration, they must provide the valid identity documents or identification certificates of the principal and agent.
Four, the floating population in the city for residence registration and continuous residence for more than half a year, and meet one of the conditions of legal and stable employment, legal and stable residence, continuous study, you can apply for a residence permit in the local police station or the service management agency entrusted by the public security organ. The continuous residence time is calculated from the date of applying for residence registration, and the residence registration information of the public security organ or the service management institution entrusted by the public security organ shall prevail.
The floating population applying for a residence permit shall fill in the Zhejiang Province Residence Permit Application (Endorsement) Form and provide the following documents, certificates and other materials:
(a) my valid identity certificate or proof of identity.
(2) I recently bareheaded 1 inch photo 1.
(3) Relevant certification materials that meet one of the conditions of legally stable employment, legally stable residence and continuous study.
1. Apply under legal and stable employment conditions.
Proof that the applicant has continuously paid social insurance 1 year or more in the urban area (excluding interruption or overdue 1 month or more, the same below).
2. Apply for legal and stable living conditions.
One of the following materials shall be provided:
(1) If you live in the residential house purchased by yourself or your immediate family members, you shall provide the house ownership certificate, immovable property certificate or collective land use certificate. If the above certificate is not obtained, the house purchase contract (or the pre-sale contract of commercial housing that has gone through the house handover procedures) shall be provided.
(two) living in the house rented by himself or his immediate family members, provide corresponding materials according to the following different situations:
(1) If the applicant rents a house with state-owned land, he/she shall provide the Hangzhou Housing Lease Registration Certificate (Residential House) with the lease term exceeding 1 year issued by the housing management department (the date of applying for the Residence Permit shall be within the lease term, the same below);
(2) Applicants who lease houses on collective land shall provide the Safety Checklist for Rental of Residential Houses in Hangzhou issued by the township government (street offices) or its entrusted community neighborhood committees (villagers' committees) and a valid lease contract (agreement) with a lease term of 1 year or more.
(3) The applicant who rents the house managed by the unit itself shall provide the house ownership certificate issued by the unit and the public housing lease certificate with the lease term exceeding 1 year or the house lease certificate issued by the property right unit;
(four) the applicant who rents the public housing and public rental housing. The public housing lease certificate issued by the housing management department with the lease term exceeding 1 year, the public housing lease agreement sealed by the housing management department or the public housing lease contract shall be provided.
Among them, minors under the age of 16 should not only meet the conditions of applying for "legally stable residence", but also provide valid "residence permit" of legal guardians such as parents and proof that one of them has paid social insurance in the urban area for more than 1 year;
3. Apply under the condition of continuous learning.
Full-time primary schools, middle schools, secondary vocational schools, ordinary colleges and universities, and scientific research institutions undertaking postgraduate education (hereinafter referred to as schools) in the urban areas of this Municipality have obtained student status and studied continuously for more than 1 year, and provide proof of student status issued by their schools; Among them, minors under the age of 16 need to provide proof that their parents or other legal guardians have paid social insurance continuously in cities and towns for more than 1 year.
Six, hold a valid "residence permit for the introduction of talents in Zhejiang Province" can be directly renewed "residence permit".
Seven, the public security organ or the service management institution entrusted by the public security organ shall actively create conditions, make full use of the Internet, mobile phone clients and other information means, and provide convenience for relevant units and individuals to declare residence registration, submit relevant materials, apply for residence permits, etc., so as to realize residence registration declaration, residence permit application and online submission of floating population information.
Eight, the public security organ shall disclose the "residence permit" application documents and inform the applicant of the "residence permit" required documents at one time. Urban construction, education, public security, civil affairs, human resources and social security, housing and housing management, market supervision, health and family planning, trade unions and other departments (organizations) should promote departmental information interconnection and data exchange, and realize the use of floating population service management related information such as residence, employment registration, social insurance, school record, industrial and commercial registration and marriage registration as soon as possible.
9. After receiving the application materials for residence permit, the local police station or the service management institution entrusted by the public security organ shall accept the application materials that are complete or meet the acceptance conditions after correction, and issue a receipt; If the application materials are incomplete, the applicant shall be informed of the contents that need to be corrected at one time; For those who do not meet the application conditions, inform the applicant of the reasons.
X. If the application conditions are met after examination, the public security organ shall issue the Residence Permit within 15 days from the date of acceptance; If the application conditions are not met after examination, the reasons shall be informed.
Eleven, the applicant to the local police station or public security organs entrusted by the service management agencies to receive documents, it shall produce the "residence permit" acceptance receipt or identity card. The certifying unit (department) can handle the mailing of residence permit, and the expenses shall be borne by the applicant.
Twelve, "residence permit" holder in the urban area of the actual residential address or place of service and other registration information changes, it should be from the date of change 10 days to bring relevant certification materials to the current residence of the police station or public security organs entrusted by the service management agencies for information change procedures.
If the holder finds that the information specified in the certificate is wrong or omitted, he may apply to the local police station or the service management institution entrusted by the public security organ for correction with relevant certification materials; If the situation is true, it should be corrected.
Thirteen, the "residence permit" is damaged or lost, the holder with my valid identity documents or proof of identity, to the current residence of the police station or public security organs entrusted by the service management agencies for replacement procedures.
Fourteen, the "residence permit" is endorsed once a year.
The holder of the residence permit shall go through the endorsement formalities at the local police station or the service management institution entrusted by the public security organ within 1 month from the date when the certificate is issued. If the holder's employment, residence and schooling situation changes and no longer meets the application conditions, he shall not be endorsed and explain the reasons.
If the holder fails to go through the endorsement formalities within the time limit, the use function of the residence permit will be suspended; For the endorsement procedures, the use function of the certificate will be restored, and the residence time of the holder in the place of residence will be continuously calculated from the date of the endorsement procedures.
Fifteen, the holder of one of the following circumstances, the "residence permit" function is terminated:
(a) no longer meet the "residence permit" application conditions, no endorsement;
(two) has been transferred to the city's urban registered population;
(3) death;
(4) Other circumstances stipulated by laws and regulations.
Sixteen, minors under the age of 16, the guardian of the application for the "residence permit", but also need to submit the applicant and his guardian's valid identity documents or proof of identity and guardianship.
Older people and disabled people with mobility difficulties may entrust their close relatives to apply for residence permits on their behalf. In addition to the relevant certification materials that the applicant meets the requirements for applying for a residence permit, the power of attorney issued by the client and the valid identity certificate or identity certificate of the agent shall also be submitted.
Seventeen, apply for the "residence permit" for the first time, free of certificate fee. If replacement or replacement is required, the certificate fee shall be paid as required. No fees shall be charged for residence registration, change of registration and endorsement.
The certificate fee is charged according to the standards approved by the price department and the financial department of Zhejiang Province.
Eighteen, when applying for residence registration, "residence permit", the parties shall be responsible for the authenticity and legality of the submitted materials. Those who provide false materials to defraud the residence permit shall be dealt with by the public security organs according to law and recorded in the comprehensive information platform of floating population.
Nineteen, the immediate family members mentioned in these rules, including spouses, parents, children, grandparents, grandparents, grandchildren, grandchildren; Immediate family members need to provide corresponding proof of relationship when handling residence registration and residence permit.
Twenty, Tonglu County, Chun 'an County and jiande city can refer to these rules.
These Rules shall come into force on February 20 19, 65438, and shall be organized and implemented by the Municipal Public Security Bureau. If the previous documents are inconsistent with the provisions of these Rules, these Rules shall prevail.
