Should the lost car and property in the community be compensated?

The property management company should compensate for the loss of vehicles in the community. If the service agreement signed between the owner and the property does not indicate that the other party is responsible for the care of non-motor vehicles and does not charge the care fee, the property company will not be responsible. In addition, it depends on whether the property is at fault in management, such as whether monitoring is started.

The basic obligation of property service enterprises is to ensure the rational use of property and maintain the public order of houses. If the obligation to protect and keep the personal and property of all owners and non-owners is regarded as an additional obligation, it violates the nature, purpose and trading habits of the property service contract, because the responsibility of the additional obligation is far greater than the main obligation in the property service contract, which violates the principles of good faith and reciprocity in the contract.

If the property is at fault, it is responsible for compensating the owner for the lost vehicle in the community. Property provides property services in accordance with the provisions of the property service contract, and fails to fulfill the provisions of the property service contract during the service process, and is at fault for the consequences of property losses caused by the owner, it shall bear the corresponding liability for compensation.

Legal basis: Article 35 of the Regulations on Property Management.

The realty service enterprise shall provide corresponding services in accordance with the stipulations of the realty service contract. The realty service enterprise fails to perform the realty service contract, causing personal and property safety damage to the owner, and shall bear corresponding legal responsibilities according to law.

Article 48 of the Regulations on Property Management

The real estate administrative departments of the local people's governments at or above the county level shall promptly handle the complaints of owners, owners' committees, property users and property service enterprises in property management activities.
