Measures of Langfang Municipality on the Administration of Urban Parking Lot

Chapter I General Provisions Article 1 In order to strengthen the management of parking lots, improve the urban traffic environment and improve the level of urban management, these measures are formulated in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China, the Interim Measures for the Administration of Parking Lots in Hebei Province and other laws, regulations and rules, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the planning, construction, use and related management activities of parking lots in urban built-up areas within the administrative area of this Municipality and in urbanization management areas determined by the people's governments of cities and counties (cities). Article 3 The term "parking lot" as mentioned in these Measures refers to the outdoor, indoor or underground parking lots of motor vehicles and non-motor vehicles and related parking facilities, including public parking lots, special parking lots, temporary parking lots, road parking berths and temporary parking spots for non-motor vehicles.

Public * * * parking lot refers to the place where the public can park motor vehicles independently or together with public * * * buildings according to the plan.

Special parking lot refers to the place where employees of the unit, owners of residential quarters or other specific groups park motor vehicles.

Temporary parking lot refers to the use of land to be built and vacant places, as well as places set up for short-term parking of motor vehicles for large-scale mass activities.

Road parking spaces refer to motor vehicle parking spaces demarcated according to law on urban roads, including driveway parking spaces and sidewalks (including parking spaces for street-facing buildings).

Temporary parking spots for non-motor vehicles refer to the parking spots designated for the public to park non-motor vehicles in the back line area of street-facing buildings. Article 4 The planning, construction, use and management of parking lots shall adhere to the principles of government leading, overall consideration, social co-governance, convenience and high efficiency, improve the modernization level of urban parking management, and promote the coordinated development of urban traffic and economy and society. Article 5 The Municipal People's Government shall lead the construction and management of parking lots in a unified way, establish a comprehensive coordination mechanism for the construction and management of parking lots, formulate policies and measures as a whole, and study and solve major problems in the construction and management of parking lots.

County (city, district) people's government and Langfang Development Zone Management Committee are specifically responsible for the construction and management of parking lots within their respective administrative areas.

Township (town) people's governments and sub-district offices shall do a good job in parking management within their respective jurisdictions, and guide neighborhood (village) committees and owners' committees to carry out parking lot management and services. Article 6 The comprehensive administrative law enforcement department of urban management is responsible for coordinating the construction and management of parking lots, organizing the preparation of special parking lot planning and the construction and management of government-invested parking lots, and setting and management of parking berths and temporary parking spots for non-motor vehicles on urban road sidewalks (including concession areas for frontage buildings).

The traffic administrative department of the municipal public security organ is responsible for the setting and management of urban road parking spaces.

The municipal natural resources and planning department is responsible for formulating parking lot standards for construction projects, ensuring and supervising parking lot construction land, and cooperating with the preparation of special parking lot planning.

The municipal housing and urban-rural construction department is responsible for the supervision and management of parking lot construction, and urges property service enterprises to do a good job in the daily management of parking lots within the property management area.

The municipal development and reform department is responsible for formulating or adjusting the relevant parking lot service charging standards.

The municipal market supervision and management department is responsible for the supervision and inspection of parking charges.

The municipal finance department is responsible for bringing the funds needed for the construction and management of government-invested parking lots into the fiscal budget at the same level.

Municipal civil air defense, administrative examination and approval, state-owned assets supervision and management, transportation and emergency management and other administrative departments shall, according to their respective responsibilities, do a good job in the construction and management of parking lots. Article 7 The people's governments of cities and counties (cities, districts) shall increase investment in the construction of public parking lots, encourage social forces to invest in the construction and operation of parking lots, and provide policy support for social forces to invest in the construction and operation of parking lots. Article 8 Strengthen the construction of intelligent parking and informatization, promote the integrated development of urban parking management and mobile Internet, support the development and promotion of mobile terminal Internet parking applications, promote the space-time replacement, wrong time enjoyment and paid use of parking resources, and improve the efficiency, accuracy and practicability of parking management.

The comprehensive administrative law enforcement department of urban management shall, jointly with the traffic management department of the municipal public security organ, establish a unified parking information management system of the whole city, and announce the information data of the use of parking spaces and charging standards in the whole city to the public.

Public parking lots and parking lot managers who provide paid services to the public should access front-end information such as vehicle identification information, vehicle access time, real-time berths, etc. Enter the parking information management system. Chapter II Planning and Construction of Parking Lot Article 9 The planning and construction of parking lots shall follow the principle of building-based parking, supplemented by off-street parking and on-street parking, coordinate the above-ground and underground space resources, rationally arrange them, and connect them with the urban transportation system. Article 10 The comprehensive administrative law enforcement department of urban management shall, jointly with the departments of development and reform, natural resources and planning, housing and urban and rural construction, traffic management of public security organs, transportation and civil air defense, organize the preparation of special plans for urban parking facilities, which shall be implemented after being approved by the people's government at the same level.

The special planning of parking facilities should clarify the policy orientation and objectives of parking management, the layout and scale of parking infrastructure, the construction sequence and countermeasures, and incorporate them into the construction planning in time.

No unit or individual may arbitrarily change the approved special planning of parking facilities. If it is really necessary to change, it shall be reported to the original examination and approval authority for approval.
