According to the relevant provisions of the Regulations of Shanghai Municipality on the Disposal of Residential Property (hereinafter referred to as the Regulations) and the Interim Measures of Shanghai Municipality on the Treatment of Family Decoration (hereinafter referred to as the Interim Measures), we hereby notify you of strengthening the treatment of residential property decoration as follows, please follow them.

First of all, property management companies should strengthen the guidance and supervision of residential decoration.

1, strengthen the publicity and guidance of standard decoration actions.

The property management company shall, in accordance with the provisions of the law, provisional rules, the preliminary property management service contract or the agreement in the property management service contract, the residential use treaty or the owners' convention, implement the responsibility of dealing with the owner's decoration of the house, formulate the instructions for the use of the house decoration, equip relevant professionals, and strengthen the publicity, guidance and supervision of the owner's decoration of the house.

The property management company shall make a notice together with the Notice of Residential Decoration in the property community it handles. Together, the "Notes on Residential Decoration" will be delivered to the owners or users to be renovated in the property treatment area and signed for.

2. Strengthen the treatment before residential decoration.

When the property management company handles the check-in formalities for the owner or user, it shall promptly inform the "decree" and shall not damage the load-bearing structure of the house, damage the surface of the house, or illegally build residential decoration. After the owner or user moves in, urge the decoration owner, user or construction unit to observe the construction operation time, and shall not engage in construction that produces serious noise from 18:00 to 8:00 the next morning and during holidays.

Property management companies should strengthen on-site inspections and inspections (including holidays), record the construction personnel and building materials entering residential areas and the shading works involving water, electricity, gas and structures in decoration construction, and take effective measures in time to discourage, stop and urge corrections.

For the owners or users who have damaged the load-bearing structure of the house, damaged the surface of the house, built illegally and refused to rectify, the property management company shall promptly inform the owners' committee and report to the relevant administrative departments for handling according to law. The property management company instructed the illegal construction personnel to suspend construction together.

4, strengthen the understanding of knowing the law, abiding by the law and fulfilling the contract.

The property management company shall urge the owners or users to abide by laws and other relevant rules, and abide by the provisions of the residential use treaty or the owners' convention.

Property management companies and residential decoration units signed an agreement, it should be urged to fulfill the agreement. After the completion of residential decoration construction, the property management company shall promptly recover the temporary residence permit. If the house and equipment are damaged, the property management company shall instruct the responsible person to repair and compensate in time.

The property management company can directly bring a civil lawsuit to the people's court for the breach of contract of the residential decoration unit according to the agreement.

In residential areas where no owners' committee has been established, owners or users have been discouraged from illegally decorating. If the prevention fails, the real estate developer or relevant owner or user may directly bring a civil lawsuit to the people's court according to the stipulations in the Shanghai Commercial Housing Sales Contract and the Residential Use Treaty.

Two, the owners' committee should show the effectiveness of autonomy.

The owners' committee shall regularly check the handling and service of the property management company, urge the owners or users of house decoration to abide by relevant laws and regulations and make an agreement, timely mediate the adjacent street trees caused by improper decoration, and discourage, stop and urge the owners or users to rectify their illegal acts.

If it is invalid to persuade the owners or users to violate the owners' convention, the owners' committee may bring a civil lawsuit to the people's court after the owners' congress or owners' congress is held.
