Regulations of Luzhou Municipality on Property Management
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites in accordance with the contract or through self-management, and to maintain the environmental sanitation and order in the property management area. Article 3 The people's governments of cities and counties (districts) shall strengthen their leadership over property management, incorporate property management into the urban management system, and make overall consideration of community construction and property management.
Encourage the adoption of new technologies and methods, improve the level of property services by relying on scientific and technological progress, and promote the construction of green and smart communities. Fourth city and county (District) people's government housing and urban and rural construction departments responsible for the supervision and management of property management activities within their respective administrative areas.
City, county (District) people's government departments in accordance with their respective responsibilities, do a good job in the supervision and management of property management activities.
Street offices and township (town) people's governments are responsible for the guidance and supervision of property management activities in their respective jurisdictions.
Neighborhood (village) committees shall assist neighborhood offices and township (town) people's governments in property management, and strengthen the guidance and supervision of owners' congresses, owners' committees and property service enterprises within the scope of autonomy. Chapter II Owners, Owners' Congress and Owners' Committee Section 1 Owners Article 5 Natural persons, legal persons and unincorporated organizations that have registered and obtained the ownership of houses according to law are owners.
If the house has been legally occupied due to legal relations such as sale, gift and inheritance, but the ownership registration has not been handled according to law, the owner shall enjoy the rights and undertake the obligations of the owner in the property management activities. Article 6 Owners shall enjoy the following rights in property management activities:
(a) to accept the services provided by the realty service enterprise and other managers in accordance with the agreement;
(two) have the right to vote on major issues of property management;
(three) the right to know and supervise the property management activities;
(four) the rights stipulated in the autonomy convention and the management statute;
(5) Other rights stipulated by laws and regulations. Seventh owners in the property management activities to fulfill the following obligations:
(a) to pay property service fees, special maintenance funds and other expenses that should be shared by the owners in accordance with regulations and agreements;
(two) to provide the realty service enterprise and the owners' committee with the contact information and accurate information of the rental and transfer of their houses;
(3) obligations stipulated in the autonomy convention and management statute;
(4) Other obligations stipulated by laws and regulations. Article 8 If the owners fail to pay the property service fees and other expenses that should be shared by the owners, the property service enterprise or the owners' committee may make a written reminder; If the payment is still not made after being urged, the owner's name, the location of the property and the amount owed can be publicized in a prominent position in the property management area, and you can also apply for arbitration or bring a lawsuit according to law. Section 2 Owners' Meeting Article 9 The owners' meeting is composed of all owners in the property management area, representing and safeguarding the legitimate rights and interests of all owners in property management activities and performing corresponding duties.
The decision of the owners' meeting is binding on all owners. Article 10 The owners' congress shall perform the following duties:
(a) to formulate and modify the management statute and the rules of procedure of the owners' congress;
(two) to elect and replace the members of the owners' committee and supervise the work of the owners' committee;
(three) to decide on the way of property management, and to select and dismiss property service enterprises;
(four) to raise and use special funds for residential maintenance;
(five) to formulate and modify the regulations on the management, use and operation of * * * parts and * * * facilities and equipment;
(six) to change or cancel the resolution made by the owners' committee that conflicts with the decision of the owners' congress;
(seven) other matters decided by the owners' meeting as determined by laws, regulations or rules of procedure. Article 11 Where a construction unit applies in writing to the subdistrict office or the township (town) people's government for the establishment of the owners' meeting, it shall also submit the list of owners, the exclusive area of owners, the total area of buildings and other documents and materials required for the preparation of the first meeting of the owners' meeting.
If the construction unit fails to apply in writing for the establishment of the owners' meeting in time, the owners may submit a written application to the subdistrict office and the township (town) people's government. In line with the conditions, the subdistrict office and township (town) people's government shall notify the construction unit to submit the relevant documents and materials specified in the preceding paragraph, and the construction unit shall submit them within seven days from the date of receiving the notice.
The property management area of affordable housing can set up the owners' meeting according to the ownership of the house, or the neighborhood offices and township (town) people's governments are responsible for organizing relevant departments, owners, property users and neighborhood (village) committees to set up management committees to perform the relevant duties of the owners' meeting. Article 12 The preparatory group consists of representatives from the owners, the construction unit, the housing and urban-rural construction departments of the county (District) people's government, the subdistrict office, the township (town) people's government and the neighborhood (village) committees, among which the number of owners' representatives shall not be less than two thirds of the total.
The preparatory group consists of an odd number of eleven or more and fifteen or less, and the specific number is determined by the sub-district office and the township (town) people's government according to the actual situation of each property management area.
Sub-district offices and township (town) people's governments may employ lawyers and other personnel or institutions with professional knowledge and service capabilities to assist the preparatory group.
