Measures of Jinan Municipality on Property Management (20 14)
The term "property management" as mentioned in these Measures refers to the activities of real estate development enterprises to select and employ property service enterprises according to law or owners to select and employ property service enterprises according to law through independent management, and owners and property service enterprises to repair, conserve and manage the property according to the property service contract, and maintain the environmental sanitation and related order in the property management area. Article 3 These Measures shall apply to the property management activities and their supervision and management within the administrative area of this Municipality. Article 4 Property management shall adhere to the principle of combining owner autonomy with professional services, territorial management with industry management, and realize the unification of social benefits, economic benefits and environmental benefits. Article 5 County (city) and District People's governments (including Jinan High-tech Zone Administrative Committee) shall establish and improve the supervision and management system of property management and the mediation mechanism of contradictions and disputes, and study and solve major problems of property management. Sixth city housing security and real estate management bureau (hereinafter referred to as the municipal housing security management department) is responsible for the supervision and management of the city's property management activities.
Counties (cities), districts (including Jinan High-tech Zone) housing security and real estate management departments (hereinafter referred to as counties (cities), district housing security management departments) are responsible for the supervision and management of property management activities within their respective jurisdictions.
Urban and rural construction, urban management and law enforcement, public security, municipal utilities, quality supervision, economy and informatization, price and other departments shall, according to their respective responsibilities, do a good job in supervision and management related to property management. Article 7 Sub-district offices and township (town) people's governments are responsible for organizing and guiding the establishment of the owners' congress and the general election of the owners' committee in their respective jurisdictions, supervising the owners' congress and the owners' committee to perform their duties according to law, organizing joint meetings of property management projects, and mediating and handling disputes in property management activities.
Community residents' committees assist neighborhood offices and township (town) people's governments to carry out work related to property management in community management and community services, and guide owners' congresses and owners' committees to carry out owners' self-management according to law. Chapter II Property Delivery and Pre-management Article 8 Before selling a new property, a real estate development enterprise shall employ a pre-property service enterprise with corresponding qualifications according to law. For residential projects with a total construction area of less than 30,000 square meters and non-residential projects with a total construction area of less than 1 10,000 square meters, qualified property service enterprises can be selected through agreement. Article 9 A real estate development enterprise shall sign a preliminary realty service contract with the selected preliminary realty service enterprise, formulate a temporary management agreement, and report the preliminary realty service contract, temporary management agreement and other information to the municipal, county (city) housing security management department for the record.
Real estate development enterprises should use the model text of the preliminary property management contract and temporary management statute formulated by the municipal housing security management department.
When a real estate development enterprise applies for the pre-sale permit or current sale of commercial housing for the record, it shall submit the preliminary property service contract and temporary management agreement filed by the housing security management department. Article 10 When a real estate development enterprise sells properties, it shall take the prophase property service contract as the content stipulated in the commercial housing sales contract, and at the same time express the temporary management statute to the buyer, who shall make a written commitment. Article 11 Before undertaking a new property, the prophase realty service enterprise shall, in accordance with the relevant provisions of the state and the stipulations of the prophase realty service contract, conduct acceptance on the parts, facilities and equipment of the property and realty service house, form a written acceptance record and affix the official seal for confirmation.
On-site inspection, the realty service enterprise shall notify the real estate development enterprise in writing that the parts and facilities of the property do not meet the requirements, and the real estate development enterprise shall timely solve and organize the realty service enterprise to reinspect.
Property inspection records should be used as an annex to the previous property service contract. Twelfth before the delivery of the property, the real estate development enterprise shall hand over the property service room and the following information to the pre-property service enterprise:
(a) the completion of the general plan, single building, structure, equipment completion drawings, supporting facilities, underground pipe network project completion drawings, household acceptance and other completion acceptance data;
(2) Technical data such as installation, use and maintenance of facilities and equipment;
(three) property quality warranty documents and property use documents;
(4) List of owners;
(5) Other materials that should be handed over.
The prophase realty service enterprise shall, when the prophase realty service contract is terminated, hand over the realty service premises and the above information to the owners' committee. Thirteenth real estate development enterprises to provide free property services, belonging to all owners * * *, for property management activities, shall not be changed without authorization.
When a real estate development enterprise applies for the initial registration of house ownership, it shall apply for the registration of property services in the property management area, which shall be recorded in the house ownership register by the house safety management department.
Property services shall be configured in accordance with the following provisions:
(1) The construction area shall be shared between three thousandths and five thousandths of the total construction area of the construction project, with a minimum of 100 square meter;
(two) should meet the normal use of water, electricity, lighting, ventilation and other functions. The office space of the owners' committee is transferred from the property service space, with a construction area of not less than 20 square meters.
