Regulations of Xining Municipality on Property Management (2020)
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings, structures and their supporting facilities and equipment and related sites in the property service area by hiring property service personnel or managing themselves, and to maintain environmental sanitation and related order. Article 3 Property management in this Municipality shall be incorporated into the community governance system, and adhere to the working pattern of Party committee leadership, government leadership, residents' autonomy, multi-party participation, consultation and co-construction, and scientific and technological support. Establish and improve the governance structure under the leadership of community (village) party organizations, with the participation of neighborhood (village) committees, owners' committees or property management committees, owners and property service providers.
Promote the establishment of party organizations by property service enterprises, owners' committees and property management committees, and give play to the leading role of party building. Article 4 Relevant entities of property management shall abide by the market rules of property services that are consistent in power and responsibility, consistent in quality and price, fair and open, maintain the market order of enjoying property services and paying fees according to law, and optimize the market environment. Article 5 The people's governments of cities and counties (districts) shall strengthen their leadership over property management, incorporate property management into the local modern service industry development planning, community construction and community governance system, and promote the standardization and marketization of property management.
The county (district) people's government is specifically responsible for the property management within its jurisdiction, establishes a comprehensive coordination mechanism for property management, clarifies the administrative departments of property management, organizes sub-district offices, township (town) people's governments, administrative departments of property management and relevant departments and units within its jurisdiction, promotes all the work of property management within its jurisdiction as a whole, and coordinates and solves major problems of property management within its jurisdiction.
City, county (District) property management administrative departments responsible for the supervision and management of property management activities within their respective administrative areas.
City, county (District) natural resources and planning, urban and rural construction, market supervision and management, public security, urban management, fire rescue, ecological environment, health, civil affairs, civil air defense, landscaping and other administrative departments shall be responsible for the relevant supervision and management work within the property management area according to their respective duties. Sixth street offices and township (town) people's governments shall organize and guide the establishment of the owners' meeting, the election of the owners' committee and the establishment of the property management committee; Supervise the owners' congress, owners' committee and property management committee to perform their duties according to law; Participate in property inspection, supervise the handover of property management projects and property service personnel to perform their obligations according to law; Supervise property management activities, coordinate the relationship between property management and community construction, and mediate property management disputes; Organize and promote the implementation of market-oriented property management in old residential quarters.
Community neighborhood (village) committees carry out specific work under the guidance of neighborhood offices and township (town) people's governments, supervise property service providers to perform their obligations according to law, and have the right to inquire about property management matters reflected by owners to owners' assembly, owners' committee and property service providers, and mediate property disputes. Article 7 During the emergency response period, the subdistrict offices and township (town) people's governments shall be responsible for implementing various emergency measures taken according to law, guiding the property service enterprises to carry out corresponding response work, and giving material and financial support.
The realty service person shall obey the unified command of the government, actively cooperate with the community neighborhood (village) committees to carry out their work under the guidance of neighborhood offices and township (town) people's governments, and implement emergency plans and emergency measures according to law. Property service providers shall implement emergency measures and other management measures implemented by the government according to law, and the owners shall cooperate with them according to law. Article 8 Encourage the adoption of new technologies and methods, promote the deep integration of Internet and property management, improve the quality and service level of property management, and promote the intelligent and green development of property services. Chapter II Property Management Areas and Facilities Article 9 Property management areas are divided according to the following provisions:
(a) the supporting facilities and equipment of the property shall be divided into a property management area; However, if the scale is too large, it is inconvenient to divide it into one property management area, or it has been divided into several closed communities, and its supporting facilities and equipment can be divided into independent property management areas;
(two) projects built by stages or projects developed and built by two or more units, and the supporting facilities and equipment have been used, can be divided into a property management area;
(3) The completed projects with relatively complete and concentrated supporting facilities can be divided into a property management area. Tenth has formed an independent property management area, no adjustment, but the owners of the property management area decided to separate or merge the property management area.
The above-ground and underground buildings, facilities, equipment and related sites within the property management area shall not be managed separately. Eleventh construction units should be in accordance with the provisions of the allocation of property services. Property services should be relatively concentrated in the center of the property management area or near the entrance and exit, above the ground and below the second floor, and there should be independent passages in residential buildings.
Development and construction by stages, before the delivery of the property service room, the construction unit shall provide the temporary property service room that meets the standards free of charge.
The office space of the owners' committee is provided from the property service room, and the area shall not be higher than 50 square meters.
